         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that she be paid basic allowance for subsistence (BAS) for the period 27 July through 13 October 2000.

3. The applicant states that she was authorized BAS but never received it.

4. The applicant’s military records show that she enlisted in the Regular Army on 1 September 1999.

5. Around July 2000, the applicant was assigned to Korea. On 13 September 2000, a request that BAS be started was submitted on a Personnel Action form, DA Form 4187-E. The Office of the Inspector General, North Atlantic Regional and Medical Command and Walter Reed Army Medical Center, confirmed that she was authorized BAS from 27 July through 13 October 2000. Her commander from Korea provided a memorandum to show she was authorized BAS from 27 July through 13 October 2000.

6. The applicant was discharged by reason of disability on 7 February 2001.

7. Records at the Defense Finance and Accounting Service – Indianapolis Center (DFAS-IN) show that the applicant received partial BAS from 28 July through 12 September 2000 and full BAS beginning 13 September 2000.

CONCLUSIONS:

1. The evidence provided shows that the applicant was authorized BAS for the period beginning 27 July 2000. However, records at DFAS-IN show that she was paid full BAS beginning 13 September 2000. This date coincides with the DA Form 4187-E dated 13 September 2000 requesting that BAS be started.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing that the applicant is entitled to full BAS for the period 27 July through 12 September 2000.

2. That the applicant be paid all due BAS as a result of the above correction.


3. That so much of the application as is in excess of the foregoing be denied.

By letter dated the same date, AR-PERSCOM informed the applicant’s spouse that he did not enroll in the RCSBP. However, the law states that the 90-day period begins the date the member receives the 20-year letter.
