         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his date of discharge from enlisted status be changed to 14 March 2000.

3. The applicant states that he was discharged effective 14 March 2000.

4. The applicant’s military records show that he served in the rank and pay grade of specialist, pay grade E-4 from 18 July 1996 to 13 March 2000 (sic). His DD Form 214 (Certificate of Release or Discharge from Active Duty), dated 13 March 2000 indicates he served on active for 3 years, 7 months and 26 days and separated on 13 March 2000.

5. Orders 074-0002, Walter Reed Army Medical Center, Washington, DC directed the applicant’s date of discharge as 13 March 2000.

6. TAPC-OPD-RD Orders A-03-003235, Total Army Personnel Command, St. Louis, Missouri, dated 8 March 2000 directed the applicant to report to Ft. Sam Houston, Texas on 19 March 2000 with a will proceed date of 14 March 2000.

7. On 15 March 2000, he was administered the Oath of Office as a first lieutenant, Medical Service Corps.

CONCLUSIONS:

1. The applicant should have been discharged from enlisted status effective 14 March 2000, in order to comply with pertinent orders and to preclude a break in service.

2. Pertinent orders directed his date of rank as the date of entry into the Army, in a commissioned status.

3. Orders 074-0002 incorrectly show a date of discharge as 13 March 2000.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was discharged on 14 March 2000 instead of 13 March 2000.
