2.  The applicant requests, in effect, correction of his military records to show that he enlisted for a term of 5 years vice 4 years.

3.  The applicant enlisted in the Army Reserve on 22 April 1997.  His DD Form 4/1, dated 22 April 1997 indicates that he was enlisting in the Regular Army for 4 years.  His DD Form 4/3, dated 12 August 1997, indicated that he enlisted in the Regular Army for 4 years.  Additional documents signed by the applicant and the enlistment counselor all indicate enlistment for 5 years.

4.  In an advisory opinion to the Board, the Total Army Personnel Command (PERSCOM) advised that the DD Form 4/1 and 4/3 incorrectly shows enlistment for 4 years.  All related documents correctly show enlistment for 5 years.  PERSCOM recommended approval of the applicant’s request.

CONCLUSIONS:

1.  Based on the evidence of record, it appears that it was the applicant’s intent to enlist in the Regular Army for a period of 5 years.  However, an error was made on the DD Form 4/1 and DD Form 4/3.

2.  In view of the foregoing, it would be appropriate and just to correct the applicant’s records as recommended below.

RECOMMENDATION:

  That all of the Department of the Army records related to this case be corrected by amending the DD Form 4/1 and DD Form 4/3 to show that he enlisted for 5 years.
