2. The applicant requests, in effect, correction of his military records to show that he enlisted for a term of 2 years and 23 weeks vice 4 years.
3. The applicant enlisted in the Army Reserve on 2 July 1996. It shows that he agreed to serve on active duty for 4 years. He enlisted in the Regular Army on 15 November 1996. His DD Form 4/3 also shows that he enlisted for 4 years. Additional documents signed by the applicant and the enlistment counselor indicate enlistment for 2 years and 23 weeks.
4. In an advisory opinion to the Board, the Total Army Personnel Command (PERSCOM) advised that the DD Form 4/1 and
DD Form 4/3 incorrectly shows enlistment for 4 years. PERSCOM recommended approval of the applicants request.
CONCLUSIONS:
1. Based on the evidence of record, it appears that it was the applicants intent to enlist in the Regular Army for a period of 2 years and 23 weeks. However, an error was made on the DD Form 4/1 and DD Form 4/3.
2. In view of the foregoing, it would be appropriate and just to correct the applicants records as recommended below.
RECOMMENDATION:
That all of the Department of the Army records related to this case be corrected by amending the DD Form 4/1 and DD Form 4/3 to show that he enlisted for 2 years and 23 weeks.

The applicant requests that his Certificate of Release or Discharge from Active Duty, DD Form 214, be amended to give a separation code (SPD) that will allow him to retain his separation pay. Upon returning to the States, he was informed that his SPD was wrong and that was the reason his separation pay was being collected as a debt. It appears that the applicant was entitled to full separation pay but because he was given the incorrect SPD DFAS is collecting that pay as a debt.
