APPLICANT REQUESTS: In effect, the applicant requests that his date of entry on active duty on his DD Form 214 (Report of Transfer or Discharge) be changed from 8 August 1966 to August 1965.
APPLICANT STATES: He states that his date of rank of January 1966 shows that he was in the Army prior to the entry date shown on his DD Form 214.
EVIDENCE OF RECORD: The applicant's military records show:
The applicant enlisted in the Army Reserve for six years on 28 September 1965.
The applicant was ordered to active duty for training (ACDUTRA) by the Commander, VIII Corps, on 26 July 1966 with a reporting date to Fort Bliss, Texas of 8 August 1966. His pay grade on his active duty orders is E-2.
The applicants DD Form 214 shows that he was ordered to ACDUTRA on 8 August 1966, and was released to his reserve unit of assignment on 9 January 1967 (item 19c) because he had completed training in his military occupational specialty (MOS). He had 5 months and 2 days of net service during his period of active duty, and 10 months and 10 days of other service. His DD Form 214 shows his pay grade as
E-2 with a date of rank of 28 January 1966.
The applicant was discharged from the Army Reserve on
31 August 1971.
Army Regulation 635-5, then in effect, prescribes the separation documents furnished each individual who is separated from the Army, including ACDUTRA personnel, and establishes procedures for the preparation of these documents. Paragraph 4 of that regulation states that a DD Form 214 will be issued at time of separation to each member of the Regular Army and Reserve Components called or ordered to active duty or ACDUTRA for a period of 90 days or more. Paragraph 42 of that regulation states, in effect, that the date the individual entered on active duty, or for ACDUTRA personnel, the date entered on ACDUTRA, will be entered in item 19c of the DD Form 214.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, and advisory opinion(s), it is concluded:
1. The applicant was in the Army Reserve on
28 September 1965, but did not enter on active duty until
8 August 1966. The DD Form 214 issued to the applicant on
9 January 1967 includes only the period of time he was on active duty; consequently, the date of entry of
8 August 1966 on his DD Form 214 is correct. That time that the applicant served in a Reserve unit prior to his entry on active duty is shown as Other Service on his separation document.
2. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy the aforementioned requirement.
3. In view of the foregoing, there is no basis for granting the applicants request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
