2. The applicant requests that his record be corrected to show entitlement to the: (a) Combat Infantryman Badge (CIB); (b) Parachute Badge; (c) Ranger Tab; (d) Armed Forces Expeditionary Medal (AFEM); (e) National Defense Service Medal (NDSM); and (f) Good Conduct Medal (GCMDL). Additionally, he requests the following training be included on his DD Form 214 (Certificate of Release or Discharge from Active Duty), dated 9 November 1984: (g) Amphibious Reconnaissance Techniques; (h) Airborne Course; (i) Infantry Advanced Individual Training; (j) Ranger Course; (k) Jungle Warfare Course; and, (l) Nuclear Biological Chemical Defense Course. Entitlement to the CIB, Parachute Badge, and Ranger Tab is shown on his DD Form 214 and will not be further discussed.
3. On 3 December 1981, he enlisted in the Regular Army (RA). He completed his required training and was awarded military occupational specialty 11B (Light Weapons Infantryman). He further completed the airborne and ranger courses. He was advanced to pay grade E-4 effective 7 April 1983.
4. During the period 25-29 October 1983, he participated in Operation Urgent Fury, as attested to by orders for the CIB. Additionally, his Leave and Earning Statement for the period 1-30 November 1983 indicates that he received Danger Pay for the month of October 1983, only.
5. On 9 November 1984, he was honorably separated, in pay grade E-4, under Army Regulation 635-200, paragraph 6-3a, for dependency. His Report of Separation indicates that he had 2 years, 11 months and 7 days of creditable service. He was entitled to award of the Army Service Ribbon, the CIB, the Ranger Tab, and the Parachute Badge.
6. Army Regulation 672-5-1, Military Awards, then in effect, indicates, in pertinent part, that award of:
a. the AFEM, for Operation Urgent Fury, that a soldier must have served for the full period where an operation is less than 30 daysÂ’ duration. The period of Operation Urgent Fury was 23 October-21 November 1983,
b. the NDSM was awarded for honorable active service for any period between 27 June 1950 and 27 July 1954 or 1 January 1961 and 14 August 1974, and
c. the GCMDL, the first award only, is awarded upon termination of service of less than 3 years but more than 1 year.
7. Army Regulation 635-5, Personnel Separations - Separation Documents, indicates, in pertinent part, that the listing of formal, inservice training courses successfully completed during the period of service covered by the DD Form 214 is to assist the soldier after separation in job placement and counselling; therefore, training courses for combat skills will not be listed.
CONCLUSIONS:
1. The evidence of record indicates that he is entitled to award of the GCMDL; however he is not entitled to award of the AFEM and the NDSM. His contention of error, based on a reservist being activated for a specific mission; being awarded the AFEM for that service; and, subsequently being awarded the NDSM is flawed, since he was RA at the time.
2. Based on regulatory restrictions, he is not entitled to have his training listed on his DD Form 214.
3. In view of the foregoing, it would be proper to correct his Report of Separation, but only as shown below.
RECOMMENDATION:
1. That all of the Department of the Army records related to this case be corrected by showing his entitlement to award of the GCMDL.
2. That so much of the application as is in excess of the foregoing be denied.
