APPLICANT REQUESTS: That his records be corrected to show that his Basic Active Service Date (BASD) is 8 June 1977.

APPLICANT STATES: In effect, that he initially entered onto active duty in the Regular Army on 8 June 1977 and it should never change.

EVIDENCE OF RECORD: The applicant's military records show:

During the period 5 June 1977-9 September 1983 (6 years, 3 months and 5 days), the applicant served in the Regular Army (RA), as a Medical Service Corps officer.

On 27 June 1983, his unqualified resignation was approved, effective 9 September 1983, for the purpose of attending the US Army Health Professions Scholarship Program (USAHPSP).

During the period 10 September 1983-31 May 1987, the applicant attended the USAHPSP.

On 1 June 1987, he was commissioned in the Army Reserve.

On 8 June 1987, he reentered active duty.

On 11 February 1997, the Commander, US Total Army Personnel Command, opined (COPY ATTACHED) that the applicant’s BASD is 3 March 1981 and BPED is 26 February 1981.

Department of Defense Military Pay and Allowances Entitlements Manual, indicates, in pertinent part, that the method of computation of the BASD is to subtract the beginning date from the ending date of prior service and subtract from the new entry date.

DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, and advisory opinion, it is concluded:

1. In order to justify correction of a military record, the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy the aforementioned requirement.

2. The applicant’s BASD correctly computes as 3 March 1981 and BPED as 26 February 1981.

3. In view of the foregoing, there is no basis for granting the applicant’s request.

DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.

BOARD VOTE:

                       GRANT

                       GRANT FORMAL HEARING

                       DENY APPLICATION

The evidence of record also shows that this correction resulted in the applicant being credited with 2 additional days of active service based on his active duty training service during the period 23 – 24 April 1977. Thus, the applicant provides evidence to substantiate his claim that his DD Form 214, with an effective date of 31 December 1991, does not reflect credit for the 2 days of active duty training during the period 23 – 24 April 1977. However, the applicant’s DD Form 214, with an...

The applicant states that the active duty dates on the DD Form 214 are incorrect. To the contrary, the evidence indicates that the applicant had no active duty service from 1 February 1990 until his enlistment in the Army for 5 years on 15 April 1993. As a result, the Board recommends that the applicant’s 15 April 1998 DD Form 214 be corrected to show that he entered on active duty on 15 April 1993, that he had 5 years and 1 day of net active service, and that he had 3 years, 2 months, and...

A 7 January 1992 DD Form 214 shows the applicant enlisted under the Delayed Entry Program (DEP) on 7 October 1987 with entry onto active service in the Regular Army (RA) on 3 December 1987.
