2. In effect, the applicant requests that the effective date of his advancement to pay grade E-3 be adjusted from
20 June 1990 to 23 January 1990, the same date as his date of rank (DOR).

3. The applicant was advanced to pay grade E-3 on
20 June 1990 under the provisions of Army Regulation
601-210, table 2-3, rule E. His DOR on the promotion instrument (DA Form 4187) is 23 January 1990. That document indicates that the soldier needed to apply to this Board to recoup pay and correct the effective date of his promotion to 23 January 1990.

4. Army Regulation 601-210, then in effect, prescribes eligibility criteria for enlistment in the Army. Table 2-3 provides for enlistment pay grades, and rule E states, in part, that an applicant who is a high school graduate and has successfully completed sixty or more semester hours of an accredited college or university will be enlisted in pay grade E-3. Rule K states that an applicant who lacks documentation required for advanced promotion under table
2-3 may submit supporting documents to his personnel officer within 12 months of active service. Soldier will be advised of requirement to submit a request to the Army Board for Correction of Military Records to receive adjustment (pay) for effective date versus date of promotion orders.

5. Army Regulation 600-200, Chapter 7, then in effect, prescribes policy and procedures for promotion of enlisted personnel. Paragraph 7-5 states that the DOR and effective date of promotion will be the same. The date of rank may be earlier than the effective date when the commander determines that a soldier should have been advanced earlier due to administrative error or oversight. (See paragraph
7-6e(4).

6. Paragraph 7-6e(4) states that the effective date stated on a promotion instrument (orders or DA Form 4187) is the date of the instrument or a future date. For soldiers entitled to an effective date of promotion before the date of the instrument, the instrument will indicate, as additional instructions, the date the promotion should have occurred; it also will indicate that the soldier may apply to the Army Board for Correction of Military Records (ABCMR) to have the effective date of promotion corrected.

CONCLUSIONS :

1. The applicant’s effective date of advancement to pay grade E-3 should be 23 January 1990. He should receive all pay and allowances in pay grade E-3 from that date.

2. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below.

RECOMMENDATION :

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was advanced to pay grade E-3 effective
23 January 1990 and that he receive all pay and allowances in pay grade E-3 from that date.
