AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE		 CASE NUi\ IBE:n

FD-2015-00117

GENERAL : The applicant appeals for upgrade of discharge to Honorable.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING: The Board denies the upgrade of the discharge.

ISSUE:   The applicant recei ved a General discharge for Entry Level Separation - Defecti ve Enlistment Agreement.    _

The Air Force Discharge Review Board, under i ts responsi bility to examine the propriety and equity of an applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted . In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unl ess there is substantial credible evidence to rebut the presumption , to include evidence submitted by the appl icant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety.

The member claims that his discharge was improper because he was in the military for more than 180 days and his characterization should have been Honorable. Per AFI 36-3208 para 1.19.1, Airmen are in entry level status during the first 180 days of continuous active military service or the first 180 days of continuous
active mili tary service after a break of more than 92 days of active service. The member's status was determined by the date of notification. The appl icant was sti ll in entry level status at the time of his notification for his separation action; therefore hi s discharge should remain as an entry level separation.

A discharge is upgraded only if the applicant and the Board can establish that an i nequity or improp1iety took place at the time of d ischarge. After a thorough review of the records, the Board found no evidence to warrant an upgrade of the d ischarge characte1ization.

CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requi rements of the discharge regulation , was within the discretion of the discharge authority, and that the applicant was provided full administrative due process.

In view of the foregoing find ings, the Board fu11her concludes that there exists no legal or equitable basis for upgrade of discharge and determi nes the discharge should remain unchanged .
