GENERAL: The applicant appeals for upgrade of discharge to honorable, to change the reason and authority for the discharge, and to change the reenlistment code.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDING: The discharge is upgraded to Honorable. In addition the Board voted to grant a change in reason for discharge and the reenlistment code.
The Board finds that neither the evidence of record nor that provided by applicant substantiates an impropriety that would justify a change of discharge. However, based upon the record and evidence provided by applicant, the Board finds the applicant's reason and authority for discharge inequitable.
ISSUE: The applicant was discharged with an under honorable conditions (general) discharge for Misconduct: Commission of Serious Crime. The applicant contends discharge was inequitable because his DUI charge was dismissed after he was discharged. The record indicated the applicant received a Letter of Reprimand dated 6 February 2013 for driving under the influence (DUI) of alcohol. The applicant was not offered a chance for Probation and Rehabilitation after his DUI arrest. Although the Board concluded the misconduct was a significant departure from conduct expected of all military members, the Board concluded that the applicant should not be punished for making one mistake. After through consideration of the information provided by the applicant and the records of the case, the DRB concluded there was sufficient mitigation to substantiate upgrading the discharge to Honorable. Although the Board does not condone applicant's misconduct, the Board finds sufficient mitigation and extenuation based upon the applicant's overall duty performance, letters of recommendation, and the compelling statement of the applicant to consider his discharge harsh. As such, the Board grants upgrade of discharge to honorable, change of reason and authority for discharge, and change of reenlistment code.
CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.
In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determines the discharge should remain unchanged.
