GENERAL: The applicant appeals for upgrade of discharge to honorable.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined
and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDINGS: The Board denies the upgrade of the discharge.

The Board finds that neither the evidence of record nor that provided by the applicant substantiates an
inequity or impropriety that would justify a change of discharge.

ISSUES:

Applicant contends discharge was inequitable because it was too harsh. The records indicated the applicant
received two Article 15s and a Record of Individual Counseling for misconduct. His misconduct included
failure to go, underage drinking and misuse of his Government Travel Card. The DRB opined that through
these administrative actions, the applicant had ample opportunities to change his negative behavior. The
Board concluded that the negative aspects of the applicant’s service outweighed the positive contributions he
made in his Air Force career. The characterization of the discharge received by the applicant was found to
be appropriate.

Applicant states that his discharge did not take into account the good things he did while in the service. The
DRB took note of the applicant's duty performance as documented by his performance reports. They found
the seriousness of the willful misconduct offset any positive aspects of the applicant's duty performance.
The Board concluded the discharge was appropriate for the reasons which were the basis for this case.

The DRB was pleased to see that the applicant was doing well, has a family and continuing his education.
However, no inequity or impropriety in his discharge was suggested or found in the course of the hearing.
The Board concluded the misconduct of the applicant appropriately characterized his term of service.

CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and the applicant provided full administrative due process.

In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for
upgrade of discharge and determines the discharge should remain unchanged.

from this and so that I proudly tell others that I was honorably discharged. This has been a source of great shame for me. My actions

“have prevented me from obtaining jobs and getting accepted to certain colleges. Since my discharged from the military I have gotten
married and started a family. I have also started working on a college degree. I completed my first two years at a community college
and will be attending a four-year university soon. I will be majoring in Political Science with a emphasis on international affairs. I
would like to either go to graduate school or law school after that. J have a strong desire to work for the government and hope that
my behavior as a young airman will not prevent me from achieving my goals in life and providing a good life for my family. ] am
proud of the path I have taken since leaving the military. I have achieved very good grades and was invited to join an honor society
in college. I love my country and would like the opportunity to serve it again one day. I was discharged after receiving two Article
15's during my enlistment. One was for underage drinking and the other was for failure to report to assigned place at the prescribed
time. I was discharged within one month of completing my four-year enlistment. | received a five on all of my EPR's and had no

1 HUSTORY: The 335th Fighter Squadron Commander has recommended that

| Og discharged from the Air Force for misconduct, specifically minor discipli

basis for this recommendation is AFI 36-3208, Chapter 5, Section H, Paragraph 5.49. The commander

recommends a general discharge without a period of probation and rehabilitation (P&R). The respondent
is eligible for, and has been processed by, notification procedures in accordance with AFI 36-3208,

paragraph 6.2. The respondent did consult counsel and submitted a statement in his own behalf.

 
  
  

2. BASIS FOR ACTION TE .-ccives one documented counseling and two Article 15s since
24 June 1999. These actions were taken to correct various types of misconduct to include willfully

consuming alcoholic beverages while under the legal age of 21; failing to go to his appointed place of
duty; and misuse of his government credit card. A more detailed discussion of specific instances of
misconduct is contained in the squadron commander’s 23 May 2000 Notification Memorandum located at

Tab 1.

3. EVIDENCE FOR THE RESPONDENT: P| 21 years old and has served on active duty

since 2 July 1996. The respondent has received three (3) enlisted performance repogts tings of
overall five. submit a statement in his own behalf. In his sane AM
he does not ained because he has come to the realization that the military ltestyle 1s not for
him. He requests, however, an honorable discharge based on his duty performance.

4. ERRORS AND IRREGULARITIES: None

5. CONCLUSIONS:
a. Discharge is appropriate under AFI 36-3208, Chapter 5, Section H, Paragraph 5.49, which subjects
discharge when there is evidence of misconduct, specifically minor disciplinary infractions.

disrupted good order, discipline and morale within the military community; ° ge is
appropriate.

b. Characterization of Service: I concur with the commander’s recommendation of a general
discharge. According to AFI 36-3208, paragraph 5.48.4, an honorable characterization is appropriate in a
discharge for misconduct when “the member’s record has been so meritorious that any other

characterization would be clearly inappropriate.” In such cases, the GCM convening authority approves
the service characterization. On the other hand, a general discharge is warranted, according to paragraph
1.18.2, when “significant negative aspects of the airman’s conduct or performance of duty outweigh
positive aspects of the airman’s military record.” as a well-documented history of minor
misconduct since his arrival at Seymour Johnson AFB. His repeated misconduct far outweighs the

positive aspects of his service; therefore, a general discharge is appropriate.
c. Probation and Rehabilitation: I concur with the commander’s recommendation i.
be offered P&R. The Air Force has already made substantial efforts to rehabilitate this ‘gh

counseling and discipline. responsibility for his actions and correct his behavior in
response to these measures nued to engage in misconduct, thereby showing that he does
not have the capacity to be mtinued military service. Therefore, P&R is not appropriate
in this case.

  

6. LEGAL SUFFICIENCY: This case is legally sufficient, contingent upon a finding that the respondent
is medically qualified for worldwide duty.
