AIR FORCE DISCHARGE REVIEW BOARD IIECISIONAL RATIONALE

CASE NUMBER

FD-2007-00036

GENERAL: The applicant appeals for upgrade of discharge to honorable, to change the reason and
authority for the discharge, and to change the rccnlistrnent code.

The applicant was offered a personal appearancc before the Ilischarge Review Board (DRB) but declined to
exercise this right.

The attached brief contains available pertinent data on t11c applicant and the factors leading to the discharge.

FINDINGS: Upgrade of discharge, change of reason and authority for discharge, and change of
reenlistment code are denied.

The Board linds that neither the evidence of record nor that provided by the applicant substantiates an
inequity or impropriety that would justify a change of discharge.

ISSUE:

Applicant contends that he should not be penalized indefinitely for a mistake he made when young. The
DRB recognized the applicant was 23 years of age when the discharge took place. I-Iowever, there is no
evidence he was immature or did not know right from wrong. The Board reviewed the entirc record and
found no evidence of impropriety or inequity in this case on which to base an upgrade of discharge. The
records indicated the applicant received an Article 15, two Letters of Rcprimand, and two Records of
Individual Counseling for misconduct. The applicant received an Article 15 for being absent without
authority from his place of duty and for making a false official statement. He was punished with a reduction
in grade to Airman and 30 days of extra duty. The applicant had additional misconduct and was
administratively disciplined for financial irresponsibility, poor work perfbrmance, and dereliction of duty.
The Board opined the applicant was older than the vast ma-iority of first-tcrm members who properly adhere
to the Air Force's standards of conduct. The DRB coi~cluded that the characterization of the applicant's
discharge was appropriatc duc to the misconduct.

If he can provide additional documented information to substantiate an issue, the applicant should consider
exercising his right to make a personal appearance before the Board. If he should choose to exercisc his
right to a personal appearance hearing, the applica~~t should be prepared to provide the DRB with factual
evidence of the inequity and any exemplary post-service accomplishrnei~ts as well as any contributions to the
community.

CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the dischargc regulation and was within thc discretion of the
discharge authority and that the applicant was provided full administrative due process.

In view of thc foregoing findings, thc Hoard further concludes that there exists no Icgal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.
