GENERAL: The applicant appeals for upgrade of discharge to honorable.

The applicant was offered a personal appearance before the Discharge Review Board but declined to
exercise this right.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDINGS: Upgrade of discharge is denied.

The Board finds the applicant submitted no issues contesting the equity or propriety of the discharge, and
after a thorough review of the'record, the Board was unable to identify any.

Issues: The applicant submitted no issues and requested that the review be completed based on the available
service records. The Board reviewed the entire record and found no evidence of impropriety or inequity in
this case on which to base an upgrade of discharge. The records indicated applicant received two Article
15s for dereliction in the performance of maintaining a clean dormitory room and disorderly conduct while
under the influence of alcohol. Additionally, the member received four Letters of Reprimand, and three
Records of Individual Counseling. His offenses included missed appointments, failed room inspections,
failure to obey lawful orders, failure to report to duty, financial irresponsibility, and failure to complete
CDC material in the allotted time and lying. Applicant was discharged for a pattern of misconduct - conduct
prejudicial to good order and discipline. At the time of discharge, member consulted counsel and submitted
statements in his own behalf. The DRB opined that through these administrative actions, the applicant had
ample opportunities to change his negative/repetitive behavior. The Board concluded the disciplinary
infractions were a significant departure from the conduct expected ofall military members. The Board
found no evidence of impropriety or inequity in this case on which to base an upgrade of discharge.

CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.

In view of the foregoing findings the Board further concludes that there exists no legal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.

SUBJECT: Notification Memorandum - Discharge of Airman

1. Iamrecommending your discharge from the United States Air Force for a pattern of misconduct
(conduct prejudicial to good order and discipline). The authority for this action is AFI 36-3208,
section 5.50.2. If my recommendation for discharge is approved, your service will be characterized
as honorable or under honorable conditions (general). I am recommending that your service be
characterized as under honorable conditions (general).

2, My reasons for this action are as follows:

a. On or about 3 Apr 97, without authority, you failed to report for duty, to wit: Building 8265, |
CAMS Base Training. For this offense, you received a Letter of Counseling (LOC), dated 9 Apr 97
(Atch 1a).

b. On or about 19 May 97, without authority, you failed to report for duty, to wit: Building
8265, F-16 Wire Chaffing Initial Course. For this offense, you received a Letter of Reprimand
(LOR), dated 21 May 97 (Atch 1b).

c. On or about 2 Sep 97, without authority, you failed to report for duty, to wit: Building 8265,
CAMS Base Training. For this offense, you received an LOR, dated 3 Sep 97 (Atch Ic).

d. On or about 3 Dec 97, without authority, you failed to report for duty, to wit: Egress
Refresher Course. For this offense, you received an LOC, dated 6 Jan 98 (Atch 1d).

g. You were, at Moody Air Force Base, Georgia, on or about 12 October 1998, disorderly,
which conduct was of a nature to bring discredit upon the armed forces. Specifically, after drinking
alcoholic beverages you were seen urinating in a parking lot and heard making loud noises at
- approximately 0200 hours. For this action, you received nonjudicial punishment pursuant to Article
15, UCM, dated 20 Nov 98. Punishment included suspended reduction to the grade of airman
(Atch 1g).

* h. You, who knew of your duty at or near Moody Air Force Base, Georgia, On or about 22
January 1999, were derelict in the performance of that duty in that you negligently failed to maintain
a clean dormitory room, in accordance with AFI 32-6005, as it was your duty to do. For this action,
suspended nonjudicial punishment was vacated on 12 Feb 99 (Atch th).

i. On or about 15 May 99, you, violated MAFBR 90-2 section 2-7, by failing to maintain
minimum standards of cleanliness in your dorm room. For this offense, you received an LOR, dated
25 May 99 (Atch 1i).

. j. One or about 20 May 99, investigations confirmed that you failed to complete your Career

‘Development Course (CDC) materials for your skill level upgrade in the allotted 30 day period.
Also, you made a false official statement, to wit: You stated that you personally completed your
CDCs, a statement you knew not to be true. For this offense, you received an LOR, dated 4 Jun 99
(Atch 1)).

Copies of the documents to be forwarded to the separation authority in support of this
recommendation are attached. The commander exercising Special Court-Martial (SPCM)
jurisdiction or a higher authority will decide whether you will be discharged or retained in the Air
Force and, if you are discharged, how your service will be characterized. If you are discharged, you
will be ineligible for reenlistment in the Air Force.

3. You have the right to consult counsel. Military legal counsel has been obtained to assist you. I
have made an appointment for you to consult Captain (yea Bldg 5107, Room 3, at 1100 hours
on 9 Jun 99. Please take your copy of this Notification Memorandum and the attachments with you
to your appointment. You may consult civilian counsel at your own expense.

4. You have the right to submit statements in your own behalf. Any statements you want the

separation authority to consider must reach me within three duty days after receipt of this -

notification letter, unless you request and receive an extension for good cause shown. If your

_ appointment with defense counsel is beyond three duty days after receipt of this letter, you
should contact the Area Defense Counsel office at extension 7-3421 to obtain a delay request.

I will send any statement(s) you submit to the separation authority.

5. Ifyou fail to consult counsel or to submit statements in your own behalf, your failure will
constitute a waiver of your right to do so.

Base Hospital, Physical Exams Section, Bldg 3296, at 0730 on 10 Jun 1999 for the examination.
