GENERAL:  The  applicant  appeals  for  upgrade  of  discharge  to  honorable,  to  change  the  reason  and 
authority for the discharge, and to change the reenlistment code. 

'I'he  applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to 
exercise this right. 

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. 

FINDINGS:  Upgrade  of  discharge,  change  of  reasoil  and  authority  for  discharge,  and  change  of 
reenlistment code are denied. 

The  Board  finds  that  neither  the  evidence  of  record  nor  that  provided  by  the  applicant  substantiates  an 
inequity or impropriety that would justify a change of discharge. 

ISSUES: 

lssue I .   Applicant contends discharge was inequitable because it was too harsh.  The records indicated the 
applicant received an Article  1 5 and two Letters of Repri mand  for misconduct.  The misconduct included 
unprofessional conduct, operating a motor vehicle while intoxicated, and underage drinking,  The DRB 
opined that through these administrative actions, the applicant had ample opportunities to change his 
negative behavior.  The Board concluded the misconduct was a significant departure from conduct expected 
of all military members.  The characterization of thc discharge received by the applicant was found to be 
appropriate. 

lssue 2.  Applicant states that his discharge did not take into account the good things he did while in the 
service. The DRB took note of the applicant's duty performance as documcnted by his performance reports 
and other accomplishments.  Thcy found the seriousness of the willful misconduct offset any positive aspects 
of the applicant's duty performance.  The Board concluded the discharge was appropriate for the reasons 
which were the basis for this case. 

CONCLUSIONS:  The  Discharge  Rcview  Board  coilcludes  that  the  discharge  was  consistent  with  the 
procedural  and  substantive  requiremcnts  of  the  discharge  regulation  and  was  within  the  discretion  of  the 
discharge authority and that the applicant was provided full administrative due process. 

In view of the foregoing findings the Board further concludes that there exists no legal or equitable basis for 
upgrade of discharge, thus the applicant's discharge should not be changed.

Issue 1:  All infractions stated in discharge were personal issues.  I 

served my country to the best of my ability.  I was a good airman. 

Issue 2:  Others have been punished for the same infractions many times and 

have not been discharged; let alone less than honorably discharged. 

Issue 3:  I am considering returning to the service under a different 

branch; but am having issues because of my type of discharge.  I no longer 
consume alcohol and want to serve my country.  Thank you for your time.

1.  I am recommending your discharge from the United States Air Force for minor disciplinary 
infractions. The authority for this action is AFPD 36-32 and AJ?I 36-3208, Chapter 5, Section 
H, Paragraph 5.49.  If your discharge is approved, yoy service will be characterized as 
honorable or under honorable conditions (general).  I am recommending that your service be 
characterized as under honorable conditions (general). 

2.  My reason for this action is: 

a.  On or about 3 Sep 04, you conducted yourself in an unprofessional manner by using 
disparaging terms towards other members in your unit.  For this rniscofiduct you received a 
LOR, dated 7 Sep 04. 

b.  On or about 9 Jul05, you willfully failed to refrain from consuming alcoholic beverages 

while under the age of twenty-one.  For this misconduct you received an Article 15, dated 24 
JulO5. 

c.  On or about 9 May 06, you operated a motor vehicle while intoxicated. Fox this 

misconduct you received a LOR, dated 12 Jul06. 

3.  Copies of the documents to support this recommendation are attached and will be forwarded 
to the separation authority.  The separation authority will make the &dings  and 
recommendations required under 10 U.S.C. 2005(g) regarding recoupment of education 
assistance funds, if applicable.  The commander exercising special court-martial jurisdiction or 
a higher authority will decide whether you will be discharged or retained in the Air Force and, if 
you are discharged, how your service will be characterized,  If you are discharged, you will be 
ineligible for reenlistment in the Air Force and any special pay, bonus, or education assistance 
funds may be subject to recoupment. 

4.  You have the right to consult counsel.  Militarylegal counsel has been obtained to assist
