GENERAL:  The applicant appeals for upgrade of discharge to honorable. 

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to 
exercise this right. 

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. 

FINDINGS:  Upgrade of discharge is denied. 

The  Board  finds  that  neither  the  evidence  of  record  nor  that  provided  by  the  applicant  substantiates  an 
inequity or impropriety that would justify a change of discharge. 

ISSUES: Applicant contends discharge was inequitable because it was too harsh.  The records indicated the 
applicant received four Letters of Reprimand for misconduct.  The misconduct included underage drinking, 
living in the dormitories without permission, possession of alcohol, lying, failure to go, making a false 
official statement, dereliction of duty, possession of an altered military identification card, and assaulting his 
spouse. The DRB opined that through these administrative actions, the applicant had ample opportunities to 
change his negative behavior.  The Board concluded the misconduct was a significant departure from 
conduct expected of all military members.  The characterization of the discharge received by the applicant 
was found to be appropriate. 

Applicant also states that his discharge did not take into account the good things he did while in the service. 
The DRB took note of the applicant's duty performance as documented by his performance reports and other 
accomplishments.  They found the seriousness of the willful misconduct offset any positive aspects of the 
applicant's duty performance.  The Board concluded the discharge was appropriate for the reasons which 
were the basis for this case. 

CONCLUSIONS:  The Discharge Review Board concludes that the discharge was consistent with the 
procedural and substantive requirements of the discharge regulation and was within the discretion of the 
discharge authority and that the applicant was provided full administrative due process. 

In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for 
upgrade of discharge, thus the applicant's discharge should not be changed.

to have the opportunity to serve my country again.  I have medals and references to show that outside of my marital complications, 
I was a good airman and tried very hard at what I did.  I was part of the Lackland AFB honor guard, and the Lackland Warhawks

SUBJECT:  Notification Memorandum 

1.  I am recommending your discharge from the United States Air Force for A Pattern of 
Misconduct, specifically, Conduct Prejudicial to Good Order and Discipline.  The basis for this 
action is AFPD 36-32 and AFI 36-3208, paragraph 5.50.2.  If my recommendation is approved, 
your service will be characterized as Honorable, Under Honorable Conditions (General) or 
Under Other Than Honorable Conditions.  I am recommending your service be characterized as 
Under Honorable Conditions (General). 

2.  My reasons for this action are: 

a.  On 14 Jul04, you were apprehended by 37th Security Forces for underage drinking and 

failure to identify.  You were also unlawfblly living in the AIA dormitory room of another 
Airman.  As a result, you received a Letter of Reprimand (LOR), dated 3 Aug 04. 

b.  During the period of 3 - 7 Jan 05, you failed to go to your appointed place of duty, 

following your ADAPT appointments.  You also lied to your supervisory chain about the length 
of your ADAPT appointments.  As a result, you received an LOR, dated 26 Jan 05, and an 
Unfavorable Information File (UIF) was established.  Further, you were non-recommended for 
promotion to Senior Airman for a period of 60 days (2 1 May 05). 

c.  On 23 Apr 05, you were involved in several disciplinary infi-actions; you assaulted your 
spouse, you consumed alcohol underage, lied to MSgt- - - - - - - J by saying you did not consume 
alcohol, and you were derelict in your duties by consuming alcohol while being on standby 
status.  As a result, you received an LOR, dated 26 Apr 05.

d.  On 30 Apr 05, you were apprehended by 37th Security Forces for underage drinking.  As a 

result, you received an LOR, dated 2 May 05. 

3.  Copies of the documents to be forwarded to the separation authority in support of this 
recommendation are attached.  The commander exercising SPCM jurisdiction or higher authority 
will decide whether you will be discharged or retained in the Air Force.  If you are discharged, 
you will be ineligible for reenlistment in the Air Force and will probably be denied enlistment in 
any component of the armed forces. 

4.  You have the right to counsel.  Military legal counsel can be obtained to assist you.  An 
appointment can be made for you to meet with the Area Defense Counsel (ADC) at Building
