GENERAL:  The applicant appeals for upgrade of discharge to honorable, to change the reason and 
authority for the discharge, and to change the reenlistment code. 

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to 
exercise this right. 

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. 

FINDINGS:  Upgrade of discharge, change of reason and authority for discharge, and change of 
reenlistment code are denied. 

The Board finds the applicant submitted no issues contesting the equity or propriety of the discharge, and 
after a thorough review of the record, the Board was unable to identify any that would justify  a change of 
discharge. 

ISSUE: 

Issue.  The applicant cited her desire to serve once again in the armed forces.  The records indicated the 
applicant received an Article  15, a Vacation, four Letters of Reprimand, a Letter of Admonishment and two 
Records of Individual Counseling for misconduct.  The applicant was disciplined with four L,etters of 
Reprimand for failure to make required progress in the Weight Management Program, failure to obey a 
lawful order, larceny and wrongful appropriation, and being late for work.  The Letter of Admonishment was 
for being disrespectful to a superior commissioned officer.  The applicant had further misconduct and 
received an Article  15 and Vacation for failure to go to appointed place of duty on three separate occasions 
and failure to wear Chef Whites while perfomling duties at the dining facility.  Her misconduct resulted in 
reduction to airman and fifteen days of extra duty.  'T'he DRB opined that through these administrative 
actions, the applicant had ample opportunities to change her negative behavior.  The Board concluded the 
misconduct was a significant departure from conduct expected of all military members.  The characterization 
of the discharge received by the applicant was found to be appropriate. 

CONCLUSIONS:  The Discharge Review Board concludes that the discharge was consistent with the 
procedural and substantive requirements of the discharge regulation and was within the discretion of the 
discharge authority and that the applicailt was provided full administrative due process. 

In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for 
upgrade of discharge, thus the applicant's discharge should not be changed.

SUBJECT: Notification Memorandum 

I am recommending your discharge fiom the United States Air Force for Misconduct -- Minor 
1. 
Disciplinary Infractions. The authority for this action is AFPD 36-32 and AFI 36-3208, Chapter 5, 
Section H, Paragraph 5.49.  If my recommendation is approved, your service will be characterized as 
honorable or general.  I am recommending that your service be characterized as general. 

2.  My reasons for this action are: 

a.  On 9 December 1996, you failed to report to your scheduled Equal Opportunity and Treatment 

Training.  As a result, you received a Record of Individual Counseling, dated 11 December 1996. 

b.  On 29 December 1996, you  reported to work forty minutes late.  For your misconduct, you 

received a Record of Individual Counseling dated, 30 December 1996. 

c.  On 6 February 1997, you failed to report to work at the required time.  For your dereliction, you 

received a Letter of Reprimand dated, 6 February  1997. 

d.  On 2 June 1997, while yaw roommate was on leave, you removed £60 from her dresser without 

her permission in order to purchase a train ticket to Liverpool.  For wrongfully appropriating your 
roommate's money, you received a Letter of Reprimand dated, 10 June 1997.

e.  On 27 November 1997, you spoke inappropriately toward ~olonei

completing a canyout meal for a customer.  As a result, you received a Letter of Admonishment, dated 1 
December 1997. 

f.  On 4 Septem bet 1998, you failed to report to work at the requ&d!i-mfi  pf0600 hours.  You 
reported to work at 0730 hours after being awakened by Airman BasicL-- -- -- - - - - _ - ,

received a Letter of Reprimand dated, 9 September 1998. An Unfavorable Information File (UIF) was 
also established. 

g.  On  17 September 1998, you failed to report to work on time.  On 2 1 September 1998, you 

failed to go to the firing range at the required time.  On 25 September 1998, you failed to report to 
building 450 at the time pnscribed.  For your repeated failures to report on time for duty, you received 
nonjudicial punishment under Article 15, UCMJ, dated 1 October 1998.  As a result of the nonjudicial 
punishment, you received a suspended reduction to the grade of Airman and fiReen days extra duty.

3.  Copies of the documents to be forwarded to the separation authority in support of this 
recommendation are attached.  The commander exercising SPCM jurisdiction or a higher authority will 
decide whether you will be discharged or retained in the Air Force, and if you are discharged, how your 
service will be characterized.  If you are discharged, you will be ineligible for reenlistment in the Air 
Force. 

4.  You have the right to consult counsel.  Military !eg4counsel  has been obtained to assist you.  I 
have made an appointment for you to consult Capt; - - - - - l ~ r e a  Defense Counsel, at Building 976, 
RAF Lakenheath, DSN 226-3608, on Friday, 30 October 1998, at 0900 hours.  You may consult 
civilian counsel at your own expense. 

5.  You have the right to submit statements in your own behalf.  Any statements you want the 
separation authority to consider must reach me by Monday, 2 November 1998 unless you request 
and receive an extension for good cause shown.  I will send them to the sepwtion authority. 

If you fail to consult counsel or to submit staternenb in your own behalf, your failure will

constitute a waiver of your right to do so. 

7.  You have been scheduled for a medical examination. You must report to Building 954, RAF 
Lakenheath, Physical Exams Section, on Thursday, 29 October 1998 at 0730, wlth your medical 
records.  You must be it1 uniform.  If you have been prescribed glasses, you must wear your glasses to 
the appointment. 

8.  Any personal information you furnish in rebuttal is covered by the Privacy Act of 1974.  A copy of 
AFI 36-3208 is available for your use at the unit orderly room or the Area Defense Counsel office.
