VI. Facts, Circumstances, and Legal Basis for Separation
a. Facts and Circumstances:
The specific facts and circumstances leading to the applicant's discharge from the Army are not contained in the available records. However, the record does contain a properly constituted DD form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applican't signature. Her DD Form 214 indicates that she was discharged under the provisions of Chapter 8, AR 635-200, by reason of pregnancy, with a characterization of service of general, under honorable conditions. Furthermore, the DD Form 214 shows a Separation Code of KDF(i.e., pregnancy). On 23 September 2004, Orders 267-0262, DA, HQ, XVIII Airborne Corps and Fort Bragg, NC discharged the applicant from the Regular Army, effective date: 22 October 2004.
b. Legal Basis for Separation:
Army Regulation 635-200 sets forth the requirements and procedures for administrative discharge of enlisted personnel. Chapter 8 provides for the voluntary separation of enlisted woman because of pregnancy. Service of enlisted woman separated under the provisions of Chapter 8 will be characterized as honorable or general, under honorable conditions unless the soldier in an entry level status.
c. Response to Issues, Recommendation and Rationale:
After a careful review of all the applicant's available military records, and the issue she submitted, the analyst found no mitigating factors that would merit an upgrade of the applicant's discharge. The analyst determined that the applicant voluntarily requested separation under the provisions of Chapter 8, AR 635-200, due to pregnancy. This document identifies the reason and characterization of the discharge and the analyst presumed Government regularity in the discharge process. The analyst determined that the reason for discharge and the characterization of service were both proper and equitable recommends to the Board to deny relief.

Facts, Circumstances, and Legal Basis for Separation a. While the applicant's specific facts for which she may have received a general discharge are not contained in the available record, the overall length and quality of the applicant's service, to include her two combat deployments and the lack of any evidence of misconduct as her DD Form 214 indicates she was discharged as an E-4 mitigated the possible discrediting entry. The record of evidence shows the applicant submitted her request for voluntary separation under the provisions of Chapter 8, AR 635-200, by reason of pregnancy.
