GENERAL: The applicant appeals for upgrade of discharge to Honorable.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to
exercise this right.
The attached brief contains.the available pertinent data on the applicant and the factors leading to the
discharge.
FINDINGS: Upgrade of discharge is denied.
The board finds that neither the evidence of record nor that provided by the applicant substantiates an
inequity or impropriety, which would justify a change of discharge.
The applicant’s issues are listed in the attached brief.
Issue. The Board finds that the applicant submitted no issues contesting the equity or propriety of the
discharge, and after a thorough review of the record, the board was able to identify none. The records
indicated the applicant received two Article 15s and eight Letters of Reprimand for misconduct. The
misconduct included disobeying a lawful order, sleeping on post on four separate occasions, failure to go,
speeding, underage drinking and driving, making false official statements, failure to report to mandatory
appointment, late for work, and sleeping in class. The DRB opined that through these administrative
actions, the applicant had ample opportunities to change his negative behavior. The Board concluded the
misconduct was a significant departure from conduct expected of all military members. The
characterization of the discharge received by the applicant was found to be appropriate.
CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.
In view of the foregoing findings the board further concludes that there exists no legal or equitable basis for
upgrade, thus the applicant's discharge should not be changed.

SUBJECT: Notification Memorandum
1. Iam recommending your discharge from the United States Air Force for a pattern of
misconduct, specifically conduct prejudicial to good-order and discipline. The authority for this
action is AFPD 36-32 and AFI 36-3208, paragraph 5.50.2, If my recommendation is approved,
your service may be characterized as honorable or under honorable conditions (general). I am
recommending your service be characterized as general.
2. My reasons for this action are:
a. On or about 23 May 00, you failed to go at the time prescribed to your appointed place of
duty. As a result, you received a Letter of Counseling (LOC) (Tab A).
b. On or about 24 May 00, you failed to go at the time prescribed to your appointed place of
duty. As a result, you received a Letter of Reprimand (LOR) (Tab B).
c. On or about 13 Jun 00, you were found sleeping on duty. As a result, you received an
LOR (Tab C).
d. On or about 16 Nov 00, the Tucson Police Department detained you for speeding and for
having liquor in your system while under the age of 21 years. As a result, you received an LOR
and an Unfavorable Information File (UIF) was established and your installation driving
privileges were suspended for 6 months (Tab D).
e. On or about 17 Mar 01, you were found sleeping upon your post as sentinel. As a result,
you received punishment under Article 15 of the UCMJ and an entry was made in your existing
ULF (Tab E), .
f. On or about 23 Mar 01, you failed to go at the time prescribed to your appointed place of
duty. Asa result, you received an LOR (Tab F).
g. On or about 14 Jun 01 and 15 jun 01, on various occasions, you fell asleep during a
mandatory Substance Abuse Awareness Seminar. As a result, you received an LOR (Tab G).

h. On or about 14 Oct 01 and 29 Oct 01, you were found sleeping upon your post as
sentinel; and on or about 28 Oct 01, you willfully disobeyed a noncommissioned officer’s order
to walk your post for the remainder of your shift. As a result, you received punishment under
Article 15 of the UCMJ (Tab H).
i. On or about 12 Dec 01, you failed to go at the time prescribed to your appointed place of
duty. As a result, you received an LOR (Tab I).
‘3. Copies of the documents to be forwarded to the separation authority in support of this
recommendation are attached. The commander exercising SPCM jurisdiction or a higher
authority will decide whether you will be discharged or retained in the Air Force and, if you are
discharged, how your service will be characterized. If you are discharged, you will be ineligible
for reenlistment in the Air Force and will probably be denied enlistment in any component of the
armed forces and any special pay, bonus, or education assistance funds may be subject to
recoupment.
4. You have the right to consult counsel. Military legal counsel, iin.
AFLSA/ADC, 228-5664, has been obtained to assist you. An appointment has been scheduled
for you to consult her on at hours in Bldg 3510. You may consult
civilian counsel at your own expense.
5. You have the right to submit statements in your own behalf. Any statements you want the
separation authority to consider must reach me by2.54e%. O-unless you request and receive an
extension for good cause shown. I will send them to the separation authority.
6. If you fail to consult counsel or to submit statements in your own behalf, your failure will
constitute a waiver of your right to do so.
7, You have been scheduled for a medical examination. You must report to the Physical Exams
Office of the Aeromedical Facility, Bldg 400, Rm 163, at_OFY4S on _24 Jaw o7-for the
examination.
8. You have been scheduled for an initial outprocessing briefing. You must report to the
Military Personnel Flight (MPF), Separations Element, Bldg 3200, Rm 20, at on
for the briefing. If you have questions, please call 228-5366. .
9. Any personal information you furnish in rebuttal is covered by the Privacy Act of 1974. You
