GENERAL: The applicant appeals for upgrade of discharge to honorable.

The applicant was offered a personal appearance before the Discharge Review Board but declined to
exercise this right.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDINGS: Upgrade of discharge is denied.

The Board finds the applicant submitted no issues contesting the equity or propriety of the discharge, and
after a thorough review of the record, the Board was unable to identify any.

Issues. Applicant was discharged for commission of a serious offense, and received a general (under
honorable conditions) characterization of service. Member received an Article 15 for stealing a 40 MM, M-
203 High Explosive round, and for unlawfully striking his wife on divers occasions between | Dec 2000
and 6 March 2002, a 15-month period. As a result he was disqualified from further service in the Security
Forces career field. In his reply to the Article 15, member admitted his guilt and apologized for his actions.
He was also directed to undergo evaluation at the Life Skills Center for partner relationship problems, and
was enrolled in anger management classes. At the time of the discharge member consulted counsel and
waived his right to submit statements in his own behalf. Although member only had this one Article 15, the
misconduct it documented was extremely serious, and sufficient to warrant administrative separation.
Member was essentially the same age as other airmen who complete their enlistments without disciplinary
infractions when his misconduct occurred, and there was no evidence he did not know right from wrong.
He also failed to show how his marital and personal problems were unique or different from those of other
similarly situated airmen. Therefore, the Board found the record supports the characterization of service
received.

Applicant cited his desire to receive his G.I. Bill education benefits as justification for an upgrade. While
the Board was sympathetic to the impact of the loss of these benefits on applicant, this is not a matter of
equity or propriety that warrants an upgrade.

CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.

In view of the foregoing findings the board further concludes that there exists no legal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.

Issues: I would just like to ask if my records be reviewed. I had a good
tour except the only incident I got discharged for. I need my discharged
changed so that I may get help with paying for school from the G.I. Bill.

SUBJECT: Notification Letter

1. Iam recommending your discharge from the United States Air Force for Commission of a-
Serious Offense. The authority for this action is AFPD 36-32 and AFI 36-3208, Section 5H,
paragraph 5.52.3. [If you are discharged your service may be characterized as honorable or
general. I am recommending that your service be characterized as general.

2. My reason for this action is:

Between on or about 1 Oct 01 and on or about 30 Nov 01, you stole a 40 MM, M-203
High Explosive round, property of the United States Government. Also, on divers occasions
between on or about 1 Dec 00 and on or about 6 Mar 02, you unlawfully struck your wife. For
these instances of misconduct, you received Article 15, non-judicial punishment and this
discharge action was initiated.

3. Copies of the documents to be forwarded to the separation authority in support of this
recommendation are attached. The commander exercising SPCM jurisdiction or a higher
authority will decide whether you will be discharged or retained in the Air Force and if you are
discharged, how your service will be characterized. If you are discharged, you will be ineligible
for reenlistment in the Air Force and any special pay, bonus, or education funds may be subject
to recoupment.
