AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE

CASE NUMBER
FDOl-00033

GENERAL: The applicant appeals for upgrade of discharge to Honorable, change of reason for discharge,
and change of reenlistment eligibility (RE) code.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to
exercise this right.

.

The attached brief contains the available pertinent data on the applicant and the factors leading to the
discharge.

FINDINGS: Upgrade of discharge is denied.

The board finds that neither evidence of record nor that provided by the applicant substantiates an inequity
or impropriety, which would justify a change of discharge.

The applicant's issues are listed in the attached brief.

Issues 1, & 2 are not issues but merely request that the character of service be changed on the DD Form 2 14
and that the reason for discharge be changed to convenience of government. The Board reviewed the
record and concluded the conduct for which applicant was discharged was a significant departure from the
conduct expected of all military members. The applicant was discharged in lieu of court martial action for a
positive random urinalysis. The member tested positive for illicit drugs and agreed to accept an Under Other
Than Honorable Conditions discharge. No inequity or impropriety in his discharge was suggested or found
in the course of the records review.

The Board found no evidence of impropriety or inequity in this case upon which to base an upgrade of
discharge.

CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.

In view of the foregoing findings the board fbrther concludes that there exists no legal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.

Nonetheless, in view of the relatively minor nature of the applicant’s misconduct when juxtaposed with his previous excellent duty performance, the Board concluded that the applicant’s then existing and continued mental health issues provided sufficient mitigation to warrant the upgrade of the applicant’s discharge characterization and reason. In this case, misconduct is the primary basis for the recommended discharge. [am recommending your discharge from the United States Air Force for...
