APPLICANT REQUESTS THAT: 

 

His DD Form 214, Certificate of Release or Discharge from Active 
Duty, be updated to reflect his Meritorious Service Medal (MSM).

APPLICANT CONTENDS THAT: 

 

His DD Form 214 does not reflect his MSM award. His Report on 
Individual Personnel (RIP), dated 31 Mar 83, reflects his 
supervisor intended to recommend him for the MSM.

STATEMENT OF FACTS: 

 

The applicant retired from the Regular Air Force on 31 Jul 83 in 
the grade of master sergeant after serving 22 years and 14 days 
on active duty. 

 

The MSM Criteria: The Meritorious Service Medal may be awarded 
to any member of the Armed Forces of the United States who 
distinguishes themselves by either outstanding achievement or 
meritorious service to the United States. 

 

The remaining relevant facts pertaining to this application are 
contained in the letter prepared by the appropriate office of the 
Air Force, which is at Exhibit C.

AIR FORCE EVALUATION: 

 

AFPC/DPSID recommends denial. They were unable to verify the 
applicant’s award of the MSM. Further, retroactive 
recommendations for awards for retirees/veterans beyond the 2-
year limitation must be submitted in accordance with Title 10, 
Section 1130, United States Code. In order for a request to 
reasonably be considered under these provisions, the following 
information is suggested to assist in preparing a recommendation: 


 

 1) Reconstruct award recommendation. 

 

 2) Narrative citation of the action(s). 

 

 3) Eyewitness statements attesting the act(s) of valor or 
service performed; sworn affidavits, certificates, and any other 
related documentation. 

 

The applicant’s request is incomplete and all avenues have not 
been exhausted for retroactive request of the award.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION: 

 

A copy of the Air Force evaluation was forwarded to the applicant 
on 10 Oct 12 for review and comment within 30 days. As of this 
date, this office has received no response.

THE BOARD CONCLUDES THAT: 

 

1. The applicant has exhausted all remedies provided by existing 
law or regulations. 

 

2. The application was not timely filed; however, it is in the 
interest of justice to excuse the failure to timely file. 

 

3. Insufficient relevant evidence has been presented to 
demonstrate the existence of error or injustice. We took notice 
of the applicant's complete submission in judging the merits of 
the case; however, we agree with the opinion and recommendation 
of the Air Force office of primary responsibility and adopt its 
rationale as the basis for our conclusion that the applicant has 
not been the victim of an error or injustice. Therefore, in the 
absence of evidence to the contrary, we find no basis to 
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT: 

 

The applicant be notified that the evidence presented did not 
demonstrate the existence of material error or injustice; that 
the application was denied without a personal appearance; and 
that the application will only be reconsidered upon the 
submission of newly discovered relevant evidence not considered 
with this application.
