RECORD OF PROCEEDINGS

AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

IN THE MATTER OF: DOCKET NUMBER: BC-2012-01534

 COUNSEL: NONE

 HEARING DESIRED: NO

_________________________________________________________________

APPLICANT REQUESTS THAT:

1. The fitness assessment (FA) score she received on 27 Jan 12,
be removed from the Air Force Fitness Management System (AFFMS).

2. Her Enlisted Performance Report (EPR) rendered for the period
2 Feb 11 through 1 Feb 12, be removed from her permanent
evaluation record.

_________________________________________________________________

APPLICANT CONTENDS THAT:

Her AF Form 422, Notification of Air Force Members Qualification
Status profile was changed on 25 Jan 12, two days prior to her
recorded test date of 27 Jan 12, to include the pushup testing
component. She had not had a profile change in a long time and
did not remember she had 42 days to recondition in preparation
for a new test.

No one in her unit addressed this with her until after she tested
and the contested EPR had already closed out. She contacted her
First Sergeant for advice as to how to correct this situation,
but the first sergeant delayed this advice until 9 Mar 12.

In support of her request, the applicant provides copies of her
AF Forms 422 dated 3 May 11 and 25 Jan 12, a print out of her
AFFM PT scores, her EPR closing 1 Feb 12, and an excerpt from AFI
36-2905, Fitness Program.

The applicant's complete submission, with attachments, is at
Exhibit A.

STATEMENT OF FACTS:

The applicant took her FA test on 27 Jan 12, and received a total
score of 68.75, which was recorded as “Unsatisfactory.”

She received a referral EPR based on her failed FA. She did not
file an appeal through the Evaluation Report Appeals Board
(ERAB).

On 1 Sep 12, she retired in the grade of technical sergeant (E-6)
after serving 21 years and 29 days on active duty.

AIR FORCE EVALUATION:

AFPC/DPSIM recommends updating the push-up component of the
applicant’s fitness assessment to reflect “exempt” in AFFMS;
which would change her overall composite score to 88.33
(Satisfactory).

The complete DPSIM evaluation, with attachment, is at Exhibit B.

AFPC/DPSID recommends approval of the applicant’s request to
remove her contested EPR. DPSID states that based on the
aforementioned recommendation from the subject matter expert
(AFPC/DPSIM), the action of which would adjust the applicant’s
27 Mar 12 assessment to reflect a passing score of
88.33 (Satisfactory).

DPSIM states the Fitness Assessment Cell (FAC) improperly tested
the applicant on the push-up component, and due to this fact the
applicant failed the entire assessment. Therefore, this
assessment failure was inappropriate for comment on the contested
referral EPR.

The complete DPSID evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 28 Aug 12, copies of the Air Force evaluations were forwarded
to the applicant for review and comment within 30 days. As of
this date, a response has not been received by this office
(Exhibit D).

THE BOARD CONCLUDES THAT:

1. The applicant has exhausted all remedies provided by existing
law or regulations.

2. The application was timely filed.

3. Sufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. After carefully
reviewing the evidence of record in this case, we agree with the
recommendation made by the AFPC/DPSIM to update the applicant’s

27 Jan 12 Fitness Assessment (FA) to reflect exempt in the push-
up component, which will change her overall composite score to
reflect a satisfactory rating of 88.33. Consequently, we also
agree with the recommendation of AFPC/DPSIS to remove her
referral EPR since the applicant received her referral EPR based
on her failure to meet minimum standards on her fitness test.
Evidence presented in this case reflects the applicant was
improperly tested on the push-up component of the FA. Although
the applicant is requesting that her FA dated 27 Jan 12 be
removed from the AFFMS, we believe the relief recommended by
DPSIM and DPSID is the more appropriate relief. Therefore, we
recommend her records be corrected as indicated below.

_________________________________________________________________

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that:

 a. The push-up component of her Fitness Assessment (FA)
dated 27 January 2012, be updated to reflect “exempt” in the Air
Force Fitness Management System (AFFMS).

 b. The AF Form 910, Enlisted Performance Report (AB thru
TSgt), rendered for the period 2 February 2011 through 1 February
2012, be declared void and removed from her records.

If she had been on the correct profile when she completed the June 2011 FA, she would have passed the FA with a 75.5 score and would not have received the referral EPR. DPSID states that based on the AFPC/DPSIM advisory to grant the relief sought to exempt the cardio component of the FA dated 8 June 2011, they contend that the fitness assessment failure is an inappropriate comment on the contested referral EPR, and as a result, the referral EPR should be removed from her record.
