STATEMENT OF FACTS: 
 
A  similar  appeal  was  considered  and  denied  by  the  Board  on 
8 October  2003.    For  an  accounting  of  the  facts  and 
circumstances  surrounding  the  applicant’s  request,  and,  the 
rationale  of  the  earlier  decision  by  the  Board,  see  the  Record 
of Proceedings at Exhibit F. 
 
The  applicant  requested  reconsideration  of  his  application,  by 
letter through his Member of Congress, dated 17 Dec 03; however, 
on  6  Jan  04,  his  congressional  member  was  advised  that  his 
request  did  not  meet  the  criteria  for  reconsideration  by  the 
Board.  The applicant submitted a DD Form 149, dated 17 Mar 10, 
requesting  reconsideration  of  his  application;  however,  on 
2 Mar 11,  he  was  advised  that  his  request  did  not  meet  the 
criteria for reconsideration by the Board (Exhibit G).   
 
Through his Member of Congress, the applicant submits a request 
for  reconsideration,  contending  that  the  letter  signed  by  his 
commanding  officer  is  sufficient  evidence  to  substantiate  his 
claim.   
 
In  support  of  his  appeal,  the  applicant  provides  a  letter  from 
his  member  of  congress;  a  letter  from  his  local  Veteran’s 
office, and other documents previously submitted to the Board.

THE BOARD CONCLUDES THAT: 
 
In  an  earlier  finding,  the  Board  determined  there  was 
insufficient  evidence  to  warrant  promotion  to  the  grade  of

second  lieutenant.    After  thoroughly  reviewing  the  additional 
documentation  submitted  in  support  of  the  applicant’s  appeal, 
including the signed letter recommending him for the promotion, 
the  letters  of  recommendation  from  his  Member  of  Congress  and 
comments  from  his  local  veterans’  office,  we  are  not  still  not 
persuaded  the  applicant  has  been  the  victim  of  an  error  or 
injustice warranting approval of the relief he seeks.  While the 
applicant  has  provided  a  document  that  reflects  that  his 
commander  recommended  him  for  promotion  to  the  grade  of  second 
lieutenant, 
that  the 
recommendation  was  processed  in  accordance  with  the  promotion 
policies  in  effect  at  the  time.    The  acts  of  heroism  and 
personal  sacrifice  the  applicant  endured  for  our  nation  is 
noted;  however,  in  view  of  the  above,  we  find  no  basis  upon 
which  to  recommend  favorable  consideration  of  the  applicant’s 
request.

THE BOARD DETERMINES THAT: 
 
The  applicant  be  notified  that  the  evidence  presented  did  not 
demonstrate  the  existence  of  material  error  or  injustice;  that 
the  application  was  denied  without  a  personal  appearance;  and 
that  the  application  will  only  be  reconsidered  upon  the 
submission of newly discovered relevant evidence not considered 
with this application.
