APPLICANT REQUESTS THAT:
He receive Aviator Continuation Pay (ACP) for Fiscal Year 2011
(FY11) in the amount of $10,000.

APPLICANT CONTENDS THAT:
He applied for the ACP entitlement on 1 Oct 10; however, the NDAA
was not signed into law until February 2011. As such, he was
informed that he must submit an application for correction of his
records in order to receive the ACP entitlement.
In support of his request, the applicant provides a copy of his
ACP package.

STATEMENT OF FACTS:
The applicant is currently serving in the Air National Guard
(ANG) in the grade of major (0-4).
The applicants Fiscal Year 2011 Navigator and Combat System
Operator Aviator Continuation Pay (ACP) Agreement Statement of
Understanding, dated 12 Apr 11, reflects he elected Option C -
$10,000/Yr (RC-26 Counter Drug CSOs and RPA Operators only).

AIR FORCE EVALUATION:
NGB/A1PF states that after reviewing the applicants eligibility
for ACP, they have concluded that, as presented, he is ineligible
and should not be permitted to request, execute, or be paid for
the FY11 ACP agreement. However, A1PF acknowledges that in order
to properly determine his eligibility, they need the following
documents:
a. Signed ACP Agreement (all signatures, initials, blocks
completed).
b. Current set of orders.
c. Current Aeronautical Order.
d. ACP Coordinator spreadsheet showing requested dates, TAFMS
and retirement eligibility date.
e. Proof of Undergraduate Flying Training (UFT) graduation date
(typically an Individual Data Summary IDS), proof receiving
ACIP (Flight pay).
f. All documents pertaining to any previous ACP agreements (if
applicable).
The current submission is missing the ACP Coordinator spreadsheet
and proof of UFT Graduation (IDS). If the applicant provides the
missing documents, A1PF will review his case again.

requested by NGB/A1PF.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we have been advised by NGB/A1PF that the
applicant did not meet ANG FY11 ACP eligibility requirements, as
he did not complete Undergraduate Navigator Training (UNT) until
16 October 2000. In accordance with governing policy, in order
to be eligible, he must have served 10 years after completing
either UNT or Undergraduate Flying Training. The applicants
current ACP request is to start ACP on 1 October which is 15 days
prior to him becoming eligible. Therefore, in the absence of
evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
