APPLICANT REQUESTS THAT:
1. His Officer Selection Brief (OSB) considered by the Calendar
Year (CY) 2010A (CY10A) (P0510A) Lieutenant Colonel Central
Selection Board (CSB) be corrected to reflect completion of his
coursework for a Masters Degree in National Security Studies.
2. He be considered for promotion to the grade of lieutenant
colonel by Special Selection Board (SSB) for the CY10A Lieutenant
Colonel CSB with the corrected record.

APPLICANT CONTENDS THAT:
On 31 Dec 09, he completed all course work and requested to enroll
in the eight-week comprehensive exam, the same day. His advisor
stated he would be able to complete the exam by the end of Feb 10.
The Registrars Office replied stating that his tuition assistance
was not paid and there was a balance due dating back to 2008. The
University placed a hold on his records and would not register him
for the exam. The Bolling AFB Education Office explained to the
university that the government not only made the payments but
receipts for payment were on file. The situation was corrected too
late and he was unable to register for the exam in time.
In support of his request, the applicant provides a personal
statement, and copies of a letter from the Bolling AFB Education
Office, and e-mail correspondence.

STATEMENT OF FACTS:
The applicant is presently serving on active duty in the grade of
major with a date of rank of 1 Aug 06. His Total Active Federal
Military Service Date (TAFMSD) is 10 Oct 96. A review of the OPRs
included in the applicants record for the CY10A Board, reflect
overall ratings of meets standards.
The applicant has one nonselection to the grade of lieutenant
colonel by the P0510A CSB, which met on 8 Mar 10.

in the evaluation prepared by the appropriate office of the Air
Force and can be found at Exhibit B.

AIR FORCE EVALUATION:
AFPC/DPSOO recommends denial. DPSOS states students must wait for
the official conferral of the degree to get their records updated.
However, eligible officers meeting a board have the option to
submit a letter to the board president addressing any matter of
record concerning themselves that they believe is important to
their consideration for promotion. As such, the applicant could
have written a letter to the board members prior to the convening
of the board informing them of his completed course work and of the
circumstances surrounding his noncompletion of the eight-week
comprehensive exam prior to the convening of the board.
DPSOO states based on the evidence provided, the earliest conferral
date the applicant would have been eligible for was 15 May 10.
Nothing is official until graduation date. The date awarded entry
in the Military Personnel Data System (MilPDS) is the date the
degree was conferred and not the day requirements are completed.
As such, his masters degree was not reflected on his P0510A OSB.
The completion of a masters degree is not a requirement for
promotion to lieutenant colonel. The Secretary of the Air Forces
Memorandum of Instructions (MOI) recited to the P0510A board
members specifically instructed them not to consider
academics/Professional Military Education (PME) as a pass-fail
requirement. In fact, the MOI stresses the whole-person concept.
The whole-person concept includes such factors as job
performance, professional qualities, leadership, depth and breadth
of experience, job responsibility, academic/PME, and specific
achievements. Completion of advanced academic education and PME,
like other whole person factors, must be assessed in terms of how
they enhance performance and potential, as well as, contribute to
the mission and effectiveness of the Air Force.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 13 May 11, a copy of the Air Force evaluation was forwarded to
the applicant for review and comment within 30 days. To date, a
response has not been received (Exhibit C).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice of
the applicant's complete submission in judging the merits of the
case; however, we agree with the opinion and recommendation of the
Air Force office of primary responsibility and adopt its rationale
as the basis for our conclusion the applicant has not been the
victim of an error or injustice. Therefore, in the absence of
evidence to the contrary, we find no basis to recommend granting
the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
