                            RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

IN THE MATTER OF: DOCKET NUMBER: BC-1985-04145

            COUNSEL:

            HEARING DESIRED: NO

_________________________________________________________________

APPLICANT REQUESTS THAT:

His undesirable discharge be upgraded to honorable.

_________________________________________________________________

STATEMENT OF FACTS:

A similar appeal was considered and denied by the Board on 15 Jan 86. For
an accounting of the facts and circumstances surrounding his request, and
the rationale for the earlier decision by the Board, see the Record of
Proceedings, with attachments, at Exhibit F.

The applicant submitted a DD Form 149, Application for Correction of
Military Record, undated, requesting reconsideration of the Board’s prior
decision denying upgrade of his undesirable discharge to honorable. He
believes since he had over three years of active service, he should have
received counseling regarding his mental status. On 9 May 96, the Board
staff informed the applicant his request did not meet the criteria for
reconsideration (Exhibit G).

The applicant has submitted a new DD Form 149, dated 12 Jan 11, with
attachments requesting his discharge be upgraded (Exhibit H). He believes
he should have been extended for an 18 months.

Pursuant to the Board’s request, the Federal Bureau of Investigation (FBI)
provided a copy of an Investigative Report, which is at (Exhibit I).

On 28 Mar 11, a copy of the Investigative Report was forwarded to the
applicant along with a request for post-service documentation for review
and comment within 30 days (Exhibit J). As of this date, no response has
been received by this office.

THE BOARD CONCLUDES THAT:

We have thoroughly reviewed the evidence of record and considered the
weight and relevance of the additional documentation provided by the
applicant, and whether or not it was discoverable at the time of any
previous application. However, since no new and relevant evidence has been
provided, we find the request does not meet the criteria for
reconsideration. As the applicant has been previously advised,
reconsideration is provided only where newly discovered relevant evidence
is presented which was not available when the application was submitted.
Further, the reiteration of facts we have previously addressed,
uncorroborated personal observations, or additional arguments on the
evidence of record are not adequate grounds for reopening a case.
Therefore, in view of the above and in the absence of new and relevant
evidence, we find no basis to reconsider the applicant’s request

On 29 Nov 79, the applicant, with counsel, appeared before the Air Force Discharge Review Board (AFDRB); however, the AFDRB considered and denied the applicant’s request for an upgrade of his undesirable discharge. In considering the applicant’s overall record of service, the FBI Report of Investigation, and including the letters of support and accomplishments since his discharge, we are not persuaded that an upgrade of the characterization of his discharge is warranted. ...
