His records be corrected to reflect award of the Presidential 
Unit Citation (PUC).

APPLICANT CONTENDS THAT: 

 

He was assigned to the 366th Tactical Fighter Wing (TFW); 
therefore, he is entitled to the PUC. 

 

In support of his appeal, the applicant provides copies of the 
366th TFW PUC award signed by President Nixon, and a Permanent 
Change of Stations (PCS) order.

STATEMENT OF FACTS: 

 

The applicant is a former member of the Regular Air Force, who 
served on active duty from 4 December 1968 to 16 November 1972 
for a total of 3 years, 11 months, and 13 days. He was 
progressively promoted to the grade of sergeant (E-4) with a date 
of rank of 1 May 1971. His DD Form 214, Armed Forces of the 
United States Report of Transfer or Discharge, reflects he served 
1 year and 8 months of Foreign Service.

AIR FORCE EVALUATION: 

 

AFPC/DPSIDR recommends denial. DPSIDR states after a review of 
the applicant’s master personnel records and documentation 
submitted, they were able to verify his entitlement to the Air 
Force Outstanding Unit Award (AFOUA) and the Republic of Vietnam 
Gallantry Cross with Palm (RVNGC w/P). The applicant’s record 
will be updated to reflect these awards by the appropriate 
office. However, while they acknowledge the 366th TFW was 


awarded the PUC for the period 1 April 1972 to 26 June 1972, theyfound no evidence that the applicant served with the 366thTFW.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation wasforwarded to the applicantfor review and comment within 30 days (Exhibit D). As of this 
date, this office has received no response. 

THE BOARD CONCLUDES THAT:

1.The applicant has exhausted all remedies provided by existinglaw or regulations.
2.The application was not timely filed; however, it is in the 
interest of justice to excuse the failure to timely file.
3.Insufficient relevant evidence has been presented to 
demonstrate the existence of an error or an injustice. Accordingto the evidence of record, the applicant was assigned to the 
366thOperational Maintenance Squadron. The applicant has not 
submitted evidence, nor is there evidence in the record, to 
verify he was ever assigned to the 366thTFW. A review of Air 
Force Pamphlet 900-2, Volume II, indicates that although the 
366thTFW received the PUC for the period 1 April 1972 to 26 June 
1972, the 366thOMS did not.Therefore, we agree with the 
opinion and recommendation of the Air Force office of primary 
responsibility and adopt it’srationale as the basis for our 
conclusion that the applicant has not been the victim of an erroror injustice. Therefore, in the absence of evidence to the 
contrary, we find no basis to recommend granting the relief 
sought in this application.
THE BOARD DETERMINES THAT:

The applicant benotified that the evidence presented did not 
demonstrate the existence of material error or injustice; that 
the application was denied without a personal appearance; and 
that the application will only be reconsidered upon the 
submission of newly discovered relevant evidence not considered 
with this application.
