THE APPLICANT REQUESTS THAT:
His Officer Performance Report (OPR) rendered for the period
8 January 2009 through 22 June 2009 be corrected (with the
correct signature dates); and the corrected OPR be accepted for
file in his Officer Selection Record (OSR); and that his
corrected OSR be considered for promotion to the grade of major
by a Special Selection Board (SSB) for the Calendar Year 2009C
(CY09C) Major Central Selection Board (CSB).

THE APPLICANT CONTENDS THAT:
He should have received a change of rating official (CRO) report
due to a permanent change of assignment (PCA) in June 2009. If
the OPR would have been processed on time it would have captured
his deployment in support of Operation ENDURING FREEDOM (OEF)
and been available for the promotion boards consideration. His
rating chain supports this correction, noting that a CRO was
never generated.
In support of his appeal, the applicant provides a copy of the
contested report, closing on 22 June 2009 and letters of support
from his rating chain.

STATEMENT OF FACTS:
Based on the available records, the applicants OPR rendered for
the period 8 January 2009 through 22 June 2009 was
electronically signed on 9 May 2010.
He was considered and nonselected by the CY09C Major CSB which
convened on 9 November 2009.

THE AIR FORCE EVALUATION:
AFPC/DPSIDEP defers the case to AFPC/DPSOO for consideration.
The applicant did not file an appeal through the Evaluation
Reports Appeals Board (ERAB); however, since the OPR is already
on file no action is required. The OPR in question is already
in the applicants OSR and has been placed in the Automated
Records Management System (ARMS); therefore, no action is
required at this time.
The complete AFPC/DPSIDEP evaluation is at Exhibit C.
AFPC/DPSOO, based on the DPSIDEP advisory, recommends SSB
consideration by the CY09C Major CSB with inclusion of the
corrected 22 June 2009 OPR in the applicants OSR.
Based on the governing instructions, OPRs on extended active
duty (EAD) officers are due at AFPC no later than 60 days
following closeout of the report. The 22 June 2009 OPR should
have been filed in the members OSR by 22 August 2009. However,
the rater, additional rater, reviewer, and ratee electronically
signed the OPR on 9 May 2010, after the 2 November 2009 board
convening date.

APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION:
Copies of the Air Force evaluations were forwarded to the
applicant on 3 September 2010 for review and comment within
30 days. As of this date, no response has been received by this
office (Exhibit E).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of error or injustice warranting
corrective action. The Air Force offices of primary
responsibility (OPRs) have adequately addressed the issues
presented by the applicant and we are in agreement with their
opinion and recommendation. Therefore, we recommend the
contested report be reaccomplished as recommended and the
corrected report be considered by an SSB. In view of the above,
we recommend the applicants record be corrected to the extent
indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air
Force relating to APPLICANT, be corrected to show that the
AF Form 707, Officer Performance Report, rendered for the period
8 January 2009 through 22 June 2009, was reaccomplished,
printed, and physically signed by the rater in Section IV, the
additional rater in Section V, the reviewer in Section VI, and
the ratee in Section VIII on 28 October 2009, and that the
corrected report was accepted for file in his Officer Selection
Record on 29 October 2009.
It is further recommended that he be considered for promotion to
the grade of major by a Special Selection Board (SSB) for the
Calendar Year 2009C Major Central Selection Board and any
subsequent boards for which the above corrected OPR was not a
matter of record.

The Evaluations Report Appeals Board (ERAB) granted his request to remove his OPR for 2008 from his record because a Change of Rater (CRO) OPR should have been accomplished. Additionally, the applicant filed another request to the ERAB on 19 October 2010 requesting the CY2009C PRF be removed and he be provided SSB consideration. The new PRF resurrects the same performance comments from the voided OPR and resulted in the same effect as if the original OPR and PRF were never removed. The senior rater used the PRF to make an end-run around the OPR process after the ERAB decision to void the evaluators original referral OPR and PRF.
