APPLICANT REQUESTS THAT:

He receive Special Selection Board (SSB) consideration by the CY09B  (8  Jun
09) Lieutenant Colonel Central Selection Board (CSB)  with  his  Meritorious
Service Medal with two oak leaf  clusters  (MSM  w/2OLCs)  included  in  his
record.

APPLICANT CONTENDS THAT:

His MSM was signed after his permanent change of assignment and he  was  not
aware he had received the award.  The inclusive dates of the award  were  30
Jun 06 to 29 May 09.  The award was signed on 16 Jun 09  and  faxed  to  the
Air  Force  Personnel  Center  on  26 Jun  09.   His  record  for  promotion
consideration closed on 15 Jun 09.

In support of his request, the applicant submits a copy of his signed MSM.

The applicant's complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:

Information extracted from the MilPDS indicates the applicant  is  currently
assigned as the Chief of Inspections Policy and Processes, in the  grade  of
major, having assumed that grade effective and with a date of rank of 1  Apr
04.

The applicant has two nonselections to the grade of Lt Col.

The remaining relevant facts pertaining to this application, extracted  from
the applicant’s military records, are contained in the  letter  prepared  by
the appropriate office of the Air Force at Exhibit C.

AIR FORCE EVALUATION:

HQ AFPC/DPSOO recommends denial.  DPSOO states the MSM was not  required  to
be in the applicant’s officer  selection  record  (OSR)  until  16  Aug  09.
DPSOO notes approved decorations  are  not  permitted  to  be  added  to  an
officer’s record after the promotion board has convened.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 29  Jan
10, for review and comment within 30 days.  As of  this  date,  this  office
has received no response (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of  error  or  injustice.   We  took  notice  of  the  applicant’s
complete submission in judging the merits of the  case;  however,  we  agree
with the opinion and recommendation of  the  Air  Force  office  of  primary
responsibility and adopt its rationale as the basis for our conclusion  that
the applicant has not been the victim of an error or injustice.   Therefore,
in the absence of evidence to the contrary, we find no  basis  to  recommend
granting the relief sough in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
