                            RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

IN THE MATTER OF: DOCKET NUMBER: BC-2009-01670
            INDEX CODE:  128.00
            COUNSEL: NONE
            HEARING DESIRED: NO

_________________________________________________________________

APPLICANT REQUESTS THAT:

His records be corrected to reflect his service in Vietnam.

_________________________________________________________________

APPLICANT CONTENDS THAT:

His records currently reflect his service in Thailand; however, that is
incorrect. His unit did have personnel assigned to Thailand to send drones
into South Vietnam to gather photographic intelligence information. He was
assigned duties with the remaining portion of his unit at Danang Air Base
in South Vietnam to recover the drones once they had completed their
flights.

In support of his request, the applicant submits mailing envelopes
addressed to him.

The applicant's complete submission, with attachments, is at Exhibit A.

_________________________________________________________________

STATEMENT OF FACTS:

On 5 May 69, the applicant enlisted in the Regular Air Force. His records
indicate he was assigned duties in Thailand from 27 Mar 72 to 11 Sep 72
(168 days). There is no evidence the applicant was stationed in Vietnam.

_________________________________________________________________

AIR FORCE EVALUATION:

HQ AFPC/DPAPP recommends denial.

DPAPP states specific overseas locations are not authorized entries on the
DD Form 214. The applicant was asked to provide additional documentation
verifying his Vietnam service. To date, he has not submitted the requested
information.

The complete DPAPP evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 18 Sep
09, for review and comment within 30 days. As of this date, this office
has received no response (Exhibit D).

_________________________________________________________________

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or
regulations.

2.  The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for the conclusion that
the applicant has not been the victim of an error or injustice. Therefore,
in the absence of evidence to the contrary, we find no basis to recommend
granting the relief sought in this application.

_________________________________________________________________

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
