APPLICANT REQUESTS THAT:

His records be corrected to reflect the award of the Air Medal (AM).

APPLICANT CONTENDS THAT:

He flew over 40 combat  missions  and  was  not  awarded  the  AM.   He  was
temporarily assigned duties in DaNang Republic of Vietnam from  Jun  69  and
Sep 69.  He participated in Operation PLACE DRAGON and performed over 40  A-
1 missions while assigned in Southeast Asia (SEA).  He  would  like  his  DD
Form  214,  Armed  Forces  of  the  United  States  Report  of  Transfer  or
Discharge, upgraded to include with his Veteran Affairs (VA) claim.

In support of the application, the applicant submits his personal  statement
and a certificate.

STATEMENT OF FACTS:

On 24 Aug 70, the applicant was enlisted in the  Regular  Air  Force  for  a
period of four years.  His records reflect he was TDY to Vietnam from 9  May
69 to 6 Dec 69.  He was awarded the National Defense Service Medal  and  the
Air Force Outstanding Unit Award.

In 1966, Pacific Air Force announced a change to the criteria  for  the  Air
Medal award from 25 combat or operational missions to 20 combat  operational
missions over  South  Vietnam  and  other  SEA  areas  (exclusive  of  North
Vietnam).

AIR FORCE EVALUATION:

HQ  AFPC/DPSIDR  recommends  denial.   DPSIDR   verified   the   applicant’s
entitlement to the Vietnam Service Medal with  three  Bronze  Service  Stars
(VSM w/3BSS) and the Republic of Vietnam Campaign  Medal  (RVCM).   However,
they were unable to verify his entitlement to the Air Medal.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

The applicant submitted a copy of his individual flight record dated 31  Jan
70 which indicates he flew a total of 15 combat sortie  flights  between  29
Jul 69 and 01 Sep 69.

The applicant’s complete submission is at Exhibit E.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of  error  or  injustice.   We  took  notice  of  the  applicant's
complete submission in judging  the  merits  of  the  case.   Based  on  the
documentation provided by the applicant, he only has 15 of the  required  20
combat sortie flights needed to receive the Air Medal;  however,  should  he
provide a complete copy of his AF  Form  5,  Individual  Flight  Record,  we
would reconsider his request for the  AM.   In  the  absence  of  persuasive
evidence to the contrary, we find no compelling basis to recommend  granting
the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
