APPLICANT REQUESTS THAT:

He be allowed to repay the Enlisted College Loan Repayment  Program  (ECLRP)
money he received so that he can use his current enlistment to  qualify  for
the Montgomery GI Bill (MGIB).

STATEMENT OF FACTS:

On 7 August 2008, a similar appeal was considered and denied by  the  Board.
For  an  accounting  of  the  facts  and   circumstances   surrounding   the
applicant's request and the rationale of the earlier decision by the  Board,
see the Record of Proceedings at Exhibit E.

On 14  August  2008,  the  applicant  provided  additional  information  for
consideration in which he contends that he was briefed on the CLRP while in-
processing at MEPS and was briefed on  the  MGIB  while  in  Basic  Military
Training (BMT), which caused the injustice.  He feels  that  he  has  fallen
victim to a bait and switch scheme as an enlistment incentive.   If  he  had
been given the opportunity to weigh both education programs, he  would  have
been able to make a better informed decision.

To support this request, the applicant  provided  a  personal  statement,  a
copy  of  a  DD  Form  2475,  DoD  Loan  Repayment  Program   (LRP)   Annual
Application, and a VA Form 22-1990, (VONAPP).

THE BOARD CONCLUDES THAT:

In an earlier finding, the Board determined there was insufficient  evidence
to  warrant  any  corrective  action.   After   thoroughly   reviewing   the
additional documentation  submitted  in  support  of  this  appeal  and  the
evidence of record, we  do  not  believe  the  applicant  has  overcome  the
rationale expressed in our previous decision.  Therefore,  in  view  of  the
above, and in the absence of persuasive evidence to the  contrary,  we  find
no basis upon which to recommend favorable consideration of the  applicant’s
request.

THE BOARD DETERMINES THAT:

The applicant be notified that the additional  evidence  presented  did  not
demonstrate  the  existence  of  material  error  or  injustice;  that   the
application  was  denied  without  a  personal  appearance;  and  that   the
application  will  only  be  reconsidered  upon  the  submission  of   newly
discovered relevant evidence not considered with this application.
