APPLICANT REQUESTS THAT:

His records be corrected to reflect that he elected to participate in the
Montgomery GI Bill (MGIB).

APPLICANT CONTENDS THAT:

He elected the Enlisted College Loan Repayment Benefit  (ECLRP)  which  made
him ineligible to receive the MGIB.  He was informed that his college  loans
are ineligible for ECLRP repayment because  they  are  not  federal  student
loans.  This information is  not  clearly  stated  on  the  CLRP  form.   He
suffered an injustice  due  to  misinformation.   He  served  honorably  for
almost four years, to include a tour in Iraq, with no enlistment incentive.

In support  of  the  application,  he  submits  his  enlistment/reenlistment
documents and MGIB enrollment form.

STATEMENT OF FACTS:

Applicant is currently serving in  the  Regular  Air  Force  as  a  Security
Forces member in the grade of airman first class, effective and with a  date
of rank of 18 Aug 07.

The remaining relevant facts pertaining to this application, extracted  from
the applicant’s military records, are contained in the  letter  prepared  by
the appropriate office of the Air Force at Exhibit C.

AIR FORCE EVALUATION:

HQ AFPC/DPSIT recommends denial.  DPSIT states the ECLRP  is  an  enlistment
incentive where the Air Force assists individuals by repaying a  portion  of
their outstanding federal student loans.  ECLRP pays the  lesser  amount  of
one-third or $3,333.33 per year for  three  years.   The  maximum  repayment
amount is $10,000 less federal income tax.  The ECLRP incentive election  is
confirmed by a statement  included  on  the  AF  Form  3008,  Supplement  to
Enlistment Agreement-United States Air Force.

The  MGIB  provides  benefits  for  a  variety  of  education  and  training
programs.  All eligible individuals are automatically enrolled in  the  MGIB
upon entering active duty and given  a  one-time  opportunity  to  disenroll
should they desire not to participate in the program.  Trainees may make  an
election to disenroll within two weeks of entering  active  duty  and  after
receiving a thorough briefing detailing program benefits.

The period of service used  to  repay  ECLRP  benefits  cannot  be  used  to
establish entitlement for the MGIB.  Individuals wanting to  take  advantage
of both programs can have loans  repaid  during  the  first  enlistment  and
establish MGIB eligibility during a second enlistment.  A statement to  this
effect is  included  on  the  enlistment  contracts  of  individuals  taking
advantage of the ECLRP.

The MGIB briefing includes three statements  regarding  enrollment  in  both
ECLRP and MGIB during initial enlistment and establishing  MGIB  eligibility
during a second  enlistment.   This  information  is  also  in  the  student
training guide.  The applicant elected not to participate in the MGIB.

DPSIT notes the applicant enlisted believing his  loans  would  qualify  for
repayment  under  the  ECLRP  enlistment  incentive.    He   submitted   two
qualifying federal loans and one non-qualifying private loan  for  repayment
under the ECLRP.  Payment requests totaling $2,296.97 were sent to  DFAS  in
Apr 08.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 13  Jun
08 for review and comment within 30 days.  As of this date, this office  has
received no response (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice.  We took notice of the applicant’s
complete submission in judging the merits of the case, however; we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice.  Therefore,
in the absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
