APPLICANT REQUESTS THAT:

Her records be corrected to show she was appointed at  a   higher  grade  on
her initial appointment as a commissioned officer in the United  States  Air
Force Reserve (USAFR).

APPLICANT CONTENDS THAT:

She had five years experience as a nurse when  she  was  commissioned.   She
was promised advance rank but it was not  honored.   She  was  not  accepted
into flight status due to sinusitis and had to wait for a vacancy.

In support of her request, the applicant provided a  personal  statement,  a
memorandum from the Health Professions  Recruiting  Division  and  documents
extracted from her military records

STATEMENT OF FACTS:

On 30 July 1975, the applicant enlisted in the United States  Air  Force  in
the grade of E-1.  She was progressively promoted to  the  grade  of  Master
Sergeant.  On 8 February 1987, she was commissioned a second  lieutenant  in
the USAFR Nurse Corps and was progressively promoted to the grade  of  first
lieutenant.

AIR FORCE EVALUATION:

ARPC/DPA recommends denial.  DPA states based on the documents  provided  by
the  member  and  in  accordance  with  (IAW)  AFR  36-15,  Appointment  and
Commission Grades and Designation and Assignment in Professional  Categories
- Reserve of the Air Force and United States Air Force (Temporary) dated  15
September 1981, the governing AFR in 1987, the applicant  was  appointed  at
the correct grade of  second  lieutenant.   At  that  time,  no  credit  was
awarded for work experience unless the applicant had completed a
post graduate degree (Masters or PhD).   The  applicant  only  obtained  the
minimum degree requirements for an Associate in  Arts  Nursing  degree.   If
the applicant had completed the post graduate degree and worked three  years
or more full-time as a  nurse  she  would  have  earned  12  months  credit.
Without the qualifying post graduate degree she received no credit  for  the
3 years 7 months and 23 days of work experience from the date  of  licensure
as a registered nurse, which was from 15 June 1983 through 7 February  1987,
the  day  prior  to  her  commissioning.   The   applicant   was   appointed
appropriately as a Reserve officer at the correct grade, IAW AFR 36-15,  and
Title 10, United States Code.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to applicant on 8  February
2008 for review and response.   As  of  this  date,  no  response  has  been
received by this office (Exhibit C).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to  demonstrate  the
existence of error or injustice.  After a thorough review of  the  available
evidence and the applicant’s complete submission, we find no evidence  which
would persuade us that the applicant’s service records should  be  corrected
to show she was appointed to a higher grade at the time of her  appointment.
 We agree with the opinion and recommendation of the  Air  Force  office  of
primary responsibility  and  adopt  its  rationale  as  the  basis  for  our
conclusion that the applicant was initially appointed as a  Reserve  officer
in the correct grade.  In the absence of evidence to the contrary,  we  find
no basis to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
