APPLICANT REQUESTS THAT:
He be considered by a Special Selection Board (SSB) for retention by the
Fiscal Year 2007 (FY07) Reduction in Force (RIF) Board.

APPLICANT CONTENDS THAT:
His record that met the RIF board was inaccurate as his Officer Performance
Report (OPR) closing 1 Jun 07, was not included in his Officer Selection
Record (OSR). His Recommendation Retention Form (RRF) under Job
Description states "...Department Junior Faculty Council Representative..."
when it should have read “Junior Faculty Council President." In addition,
there is no record of his Distinguished Graduate (DG) award.
In support of his request, applicant provided a personal statement, a
statement of support from his commander and documentation extracted from
his OSR. His complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
Applicant is currently serving on active duty in the grade of captain. He
was considered and not selected for retention by the FY07 RIF board.

AIR FORCE EVALUATION:
AFPC/DPSIDEP recommends denial. DPSIDEP states the DG award is mentioned
in his 15 Apr 03 OPR and reference to it is also made in the first line of
his RRF. The information was available to the RIF board. The RIF board
convening date was 11 Jun 07, and the OPR closing 1 Jun 07 was not signed
by the rater and additional rater until 18 Jun 07 and signed by the senior
rater on 20 Jun 07; therefore, it was not completed prior to the board
convening date and was not required to be on file until 60 days after close-
out.
He provided a letter from the JCF President who was in charge of elections
stating that he was voted in as the JCF President; however, the last line
of RRF Section V states "just elected Junior Faculty President!" so the
information was available to the board. The complete DPSIDEP evaluation is
at Exhibit C.
AFPC/DPSOO concurs with the comments of DPSIDEP and recommends denial of
the applicant's request. The complete DPSOO evaluation is at Exhibit D.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Applicant provided an email to the AFBCMR staff indicating it was not his
desire to respond to the Air Force evaluations.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We have reviewed the available evidence
pertaining to the applicant’s assertions that his OSR did not contain his
OPR, DG award and that his RRF reflected an inaccurate statement. The Air
Force maintains, and we are not persuaded otherwise by his assertions, that
his DG award was available to the board members at the time of the RIF
board, his OPR was not required to be filed in his OSR and the applicant
had sufficient opportunity to correct his RRF prior to convening of the RIF
board. Accordingly, we believe the RIF board had at its disposal a
sufficiently accurate record on which to base its decision. In view of the
above, we find no basis to recommend granting the relief sought in this
application.
4. The applicant’s case is adequately documented and it has not been shown
that a personal appearance with or without counsel will materially add to
our understanding of the issues involved. Therefore, the request for a
hearing is not favorably considered.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
