APPLICANT REQUESTS THAT:
His Officer Selection Record (OSR) be corrected to include his Officer
Performance Report (OPR) for the period ending 15 May 07 and he be
considered for retention by a Special Selection Board (SSB) for the L0407A
Reduction in Force (RIF) Board.

APPLICANT CONTENDS THAT:
Upon a review of his record, he noticed that his most recent OPR was not
included in his OSR. The OPR was a significant part of his record and he
wishes to have it included in his OSR. His chain-of-command had every
intention that this OPR be part of his selection record.
In support of his request, applicant provides a copy of the his OPR closing
15 May 07. The applicant’s complete submission, with attachment, is at
Exhibit A.

STATEMENT OF FACTS:
Information extracted from the Military Personnel Data System (MilPDS)
indicates the applicant is currently serving on active duty in the grade of
major, with a date of rank of 1 Oct 05. Applicant has a date of separation
of 29 Jan 08.
The applicant’s OSB contains AF Form 707A, Field Grade Officer Performance
Report, ending with the rating period 15 May 07 and AF Forms 707B, Company
Grade Officer Performance Reports beginning with the period 16 Dec 00 and
ending 6 Jun 04 with overall ratings of “Meets Standards.”

AIR FORCE EVALUATION:
AFPC/DPSOO recommends denial. DPSOO states there is no supporting
documentation from the applicant’s rating chain
showing what efforts, if any, were made to expedite the processing of the
15 May 07 OPR so that is could arrive in time to be reviewed by the L0407A
RIF Board. DPSOO advises that the OPR was not required to be on file until
15 July 2007 and since many eligible officers fall into this predicament,
approving SSB consideration with a report not required to be on file would
generate unfairness in the RIF process. The complete AFPC/DPSOO evaluation
is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Applicant communicated to the AFBCMR that it was not his desire to provide
a response to the Air Force evaluation (Exhibit E).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. Therefore,
in the absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
