APPLICANT REQUESTS THAT:

Her date of rank (DOR) be adjusted to  reflect  1  November  2005  versus  1
January 2007.

APPLICANT CONTENDS THAT:

At the time of her discharge from active duty, a code  was  entered  against
her records to reflect her declination to test for staff sergeant  while  on
active duty.  This code prevented her from being  included  on  the  Reserve
promotion eligibility rosters.

In  support  of  her  request,  applicant  provides  a  copy  of  her  email
communication regarding her promotion and a copy of  her  Reserve  promotion
order.  Her complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

On 10 May 2005, the applicant was transferred to the Air Force  Reserve  in
the grade of airman  first  class  (E-4)  for  completion  of  her  service
obligation.  She has continued to participate and  has  been  progressively
promoted to the grade of staff sergeant (E-5)  with  a  date  of  rank  and
effective date of 1 January 2007.  As of the Reserve Year  Ending  (RYE)  5
May 2006, she was credited with 7 years of satisfactory Federal service.

AIR FORCE EVALUATION:

HQ ARPC/DPB supports a 1 January 2006 correction to her  DOR  and  effective
date.  DPB advises previous Reserve promotions only occurred in odd  months,
therefore, her first  opportunity  to  be  recommended  by  her  supervisor,
commander  and  program  manager  would  have  been  for  1   January   2006
promotions.   The  applicant  provided  no  documentation  from  either  her
supervisor or program manager to indicate any recommendation  for  promotion
prior to 1 January 2007.  However,  documentation  provided  does  show  the
commander supports the applicant’s promotion.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A complete copy of the Air Force evaluation was forwarded to  the  applicant
on 4 May 2007, for review and comment within 30  days.   As  of  this  date,
this office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has  been  presented  to  demonstrate  the
existence of error or injustice.  We have noted the  Air  Force  office  of
primary  responsibility  has  indicated  they  support  a  1 January   2006
correction to the applicant’s DOR.  Additionally, documentation provided by
the applicant does show that through no fault of her own, she was left  off
eligibility rosters based on an erroneous code  carried  over  from  active
duty.  Therefore, in view of the foregoing, and in an effort to offset  any
possibility of an injustice, we agree with the recommendation of the office
of primary responsibility to allow the  applicant’s  date  of  rank  to  be
adjusted to reflect a date of rank of 1 January 2006.

4.  The applicant’s case is adequately documented and it has not been shown
that a personal appearance with or without counsel will materially  add  to
our understanding of the issue involved.   Therefore,  the  request  for  a
hearing is not favorably considered.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force  relating
to APPLICANT be corrected to show that she was promoted  to  the  grade  of
staff sergeant, Air Force Reserve, with a date of rank (DOR) and  effective
date of 1 January 2006, rather than 1 January 2007.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

            The pertinent military records of the Department of the Air
Force relating to XXXXXXXXXXXXXX, be corrected to show that she was
promoted to the grade of staff sergeant, Air Force Reserve, with a date of
rank (DOR) and effective date of 1 January 2006, rather than 1 January
2007.
