Her name and date of separation be corrected on her DD Form 214,
Certificate of Release or Discharge from Active Duty.

APPLICANT CONTENDS THAT:
The Defense Accounting and Finance Service (DFAS) has her last name listed
as “XXX” vice “XXXX.”
DFAS has her middle initial as “H” vice “M.”
Her date of separation should be “1 Feb 00” vice “29 Apr 98.”
She never received a new copy of her DD Form 214 when she was removed from
the Temporary Disability Retired List (TDRL).
In support of her request, the applicant has provided correspondence from
DFAS, a copy of her marriage certificate, and DD Form 214.

STATEMENT OF FACTS:
The applicant entered the active duty Air Force on 29 Oct 84 as a
telephone systems journeyman. She served for a period of 13 years, 6
months, and 1 day.
The applicant was placed on the TDRL on 30 Apr 98.
On 10 Jan 00, the applicant was placed on the Permanent Disability Retired
List with a combined compensable rating of 40 percent by direction of the
AFBCMR.
On 23 Dec 04, the applicant was married and assumed her husband’s last
name.

AIR FORCE EVALUATION:
AFPC/DPPD recommends denial of the request. To amend or change the
applicant’s DD Form 214 would be in violation of Air Force Instructions and
is not authorized. A DD Form 214 is to show a member’s active duty time.
Time spent on the TDRL is not active duty time. When a member is removed
from the TDRL, a new DD Form 214 is not issued. Rather, the member
receives a Special Order indicating their final status. That order becomes
a permanent part of the military personnel file, and can be attached to the
DD Form 214 reflecting final disposition.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 13 Apr
07 for review and comment within 30 days. As of this date, this office has
not received a response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. Therefore,
in the absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not

On 14 Dec 71, the Air Force PEB recommended that the removed from the TDRL and returned to active duty. For this condition to qualify for CRSC, it must be specifically granted by the DVA as presumptive to Agent Orange exposure. On 15 August 2005, a Medical Evaluation Board (MEB) reviewed the applicant’s records and referred the applicant’s case to an IPEB for further evaluation. The IPEB findings stated the applicant’s condition did not prevent her from reasonably performing her duties of her office, grade, rank, or rating; nor did it interfere with her day-to-day duties. On 18 December 2006, the applicant submitted a hardship request for a 9-12 month extension to allow surgery for both ankles and recuperation time.
AIR FORCE EVALUATION: The Physical Disability Division, AFPC/DPPD, reviewed the application and stated that it appears the applicant is requesting an increase in her compensable percentage for the disability for which she was discharged and payment for her DWSP separation, which she claims she never received.
