APPLICANT REQUESTS THAT:

His rank of private be restored to sergeant.

APPLICANT CONTENDS THAT:

His reduction in rank was an injustice.

In support of the appeal, applicant submits a copy  of  his  discharge
documents.

Applicant's complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Applicant’s master personnel record (MPR) appears to have been lost or
destroyed.  Based on the available documentation the  following  facts
are provided.

Applicant was inducted into the Army Air Force on 2 Apr 43 and entered
active duty on 9 Apr 43.  He performed duties as an Airplane  Mechanic
Gunner.  His highest grade held was sergeant.

On 13 Dec 45, while serving in the grade of private, he was discharged
for the  convenience  of  the  government  (Demobilization).   He  was
credited with one year, eight months and  three  days  of  continental
service and one year and two days of foreign service.  His  separation
document  shows  the  following:   He  participated  in  the   Eastern
Mandates,  India-Burma,  Central   Burma,   China   Offensive,   China
Defensive,  and  Air  Offensive  Japan  battles  and  campaigns.   His
separation document also shows he was entitled to the  Victory  Medal,
American Theater Ribbon, Asiatic-Pacific Theater Ribbon with 1  Silver
Battle Star, two Overseas Service Bars, Good Conduct  Medal,  and  the
Air Medal.  It further states in Item 34, Wounds Received  in  Action:
“None.”

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was not  timely  filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.  Sufficient relevant evidence has been presented to demonstrate the
existence of an injustice.  After reviewing the records  and  evidence
submitted, the Board believes relief is  warranted  on  the  basis  of
clemency.  Based on the fact that this incident happened over 60 years
ago and the applicant has been a  productive  member  of  society,  we
believe  the  applicant’s  rank  of  sergeant  should   be   restored.
Accordingly, it is our opinion that the applicant’s records should  be
corrected to the extent recommended below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT, be corrected to show that he  was  promoted  to
the grade of sergeant effective and with date of rank  of  13 December
1945.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

      The pertinent military records of  the  Department  of  the  Air
Force relating to APPLICANT, be corrected to show that he was promoted
to  the  grade  of  sergeant  effective  and  with  date  of  rank  of
13 December 1945.
