APPLICANT REQUESTS THAT:

He be awarded the Distinguished Flying Cross (DFC).

THE APPLICANT CONTENDS THAT:

His commanding officer recommended  him  for  the  DFC  on  three  different
occasions.

In support of his request, applicant provided a copy of a newspaper  article
and  correspondence  from  his  Congressional  representative.   Applicant’s
complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Applicant entered active duty on 15 April 1944, was assigned to duty in  the
Air Corps, in the grade of first lieutenant.  The applicant was assigned  to
the 494th Bomb Group, 7th Air Force, in the European Theater  of  Operations
as a B-24 Pilot, from 8 February 1945  through  7  November  1945,  when  he
returned to the Continental United States.   He  was  relieved  from  active
duty on 20  September  1946  by  reason  of  demobilization,  having  served
1 year, 8 months and 6 days of total active military  service,  of  which  9
months  was  foreign  service.   His  discharge  document   shows   he   had
participated in  the  Eastern  Mandates;  China  Offensive,  Luzon  Southern
Philippines, Air Offensive Japan and  Western  Pacific  campaigns.   He  was
awarded the Air Medal, American Theater Service Medal, World War II  Victory
Medal and the Asiatic Pacific Service Medal with 6 Six Bronze Stars.

Applicant continued to serve in the Air  Force  Reserve  in  an  active  and
inactive status until his honorable discharge from the Air Force Reserve  in
the grade of major effective 21 October 1970.

On 29 August 2006, after  a  review  of  his  available  military  personnel
record, the  Recognition  Programs  Branch,  determined  the  applicant  was
entitled to the following awards:   Army  of  Occupation  (AOM),  Philippine
Republic Presidential Unit Citation (PRPUC) and  the  Philippine  Liberation
Medal (PLM).  On  this  same  date,  the  applicant  was  advised  that  his
military records were thoroughly reviewed  and  no  official  documentation,
such as a citation, special order, or a recommendation for award of the  DFC
was found.

AIR FORCE EVALUATION:

AFPC/DPPPR recommends the application  be  denied.  AFPC/DPPPR  states  they
were unable to locate  any  official  documentation,  such  as  a  citation,
special order, or that a recommendation for award of the DFC  was  submitted
into  official  channels.   The   AFPC/DPPPR   complete   evaluation,   with
attachments is at Exhibit C.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Fore evaluation  was  forwarded  to  the  applicant  on  1
September 2006 for review and comment within 30  days.   As  of  this  date,
this office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of an  error  or  injustice.   After  a  thorough  review  of  the
available records, we found no evidence that the applicant is  eligible  for
award of the DFC.   While  we  note  the  applicant’s  contention  that  his
commanding officer recommended him for the DFC on three  occasions,  neither
the applicant nor his records provide evidence he was  recommended  for  the
DFC.  However, should the applicant  obtain  supporting  documentation  from
his commanding officer, we would be willing to reconsider this  application.
 Otherwise, without persuasive evidence he was recommended for the  DFC,  we
find no basis to warrant favorable consideration of  this  application.   We
wish to acknowledge the applicant’s contributions and personal sacrifice  in
behalf of our country and our decision in no way lessens the  value  of  his
military contributions.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
