APPLICANT REQUESTS THAT:

The name in his military personnel records be changed from G--- C. R---
 to N--- G. C. R---.

APPLICANT CONTENDS THAT:

The name on his military records is incorrect.

In support of the appeal, applicant  submits  a  copy  of  his  social
security card, his New  York benefit ID card, and his VA ID card.

STATEMENT OF FACTS:

Applicant is a former member of the Regular Air Force  who  served  on
active duty from 16 June 1970 to 25 January  1974.   He  served  three
years, seven months and three days on active duty.  He served 2 years,
1 month and 18 days of foreign and/or SEA service.

AIR FORCE EVALUATION:

AFPC/DPS recommends denial.  DPS notes that Air Force Instruction  36-
2608, Military Personnel Records System,  Chapter  5,  paragraph  5.4,
states that the documentation required to change  or  correct  a  name
are:  birth,  baptismal,  marriage,  or  naturalization  certificates;
civil court order or other legal documents; and  Table  A7.2,  Rule  5
states that a statement of circumstances and the original or certified
copy of a public record, birth or baptismal  certificate.   They  also
state a letter  was  sent  to  the  applicant  on  15  September  2006
requesting the original or a certified copy of the  birth  certificate
or court order that was in effect  at  the  time  he  enlisted  and/or
served.  However, as of 20 October 2006, the applicant has  failed  to
provide the necessary documents.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 3
November 2006 for review and comment within 30 days.  As of this date,
this office has received no response.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and recommendation of the Air Force
and adopt their rationale as the basis for  the  conclusion  that  the
applicant  has  not  been  the  victim  of  an  error  or   injustice.
Therefore, in the absence of evidence to  the  contrary,  we  find  no
basis to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
