APPLICANT REQUESTS THAT:
His records be corrected to show he was awarded the Air Force Achievement
Medal (AFAM) w/1OLC.

APPLICANT CONTENDS THAT:
He missed promotion to Technical Sergeant (E-6) by .58 in 1994. After
checking his records, he noted that he never received his medal from his
Desert Shield assignment in 1992. He was told numerous times that the
medal was on the way and that the missing medal was an oversight. He tried
for two years to obtain the medal and was told to drop the case if he
wanted to retire.
In support of his application, he submits a copy of a memorandum to his
commander, a copy of his personal statement, copies of letters to and from
his congressman, a copy of an AFAM citation, copies of supporting
statements, a copy of his TDY orders, a copy of the AFAM special order, a
copy of his emergency leave form, and copies of his EPRs.

STATEMENT OF FACTS:
The following information was extracted from the applicant’s military
personnel records. On 28 Feb 1997, the applicant was relieved from active
duty and honorably retired in the grade of Staff Sergeant (E-5). He was
credited with 20 years and 28 days of total active duty service, to include
5 years, 6 months and 5 days of Foreign Service. He was also credited with
1 year, 2 months and 7 days of Air Force Reserve service.

AIR FORCE EVALUATION:
HQ AFPC/DPPPR recommends denial. DPPPR states AFAM is awarded to Air Force
personnel for outstanding achievement or meritorious service rendered
specifically on behalf of the Air Force. A special order in the
applicant’s military personnel record indicates he was awarded the AFAM for
the period of 22 May 1990 to 1 Dec 1993 for meritorious service for his
assignment in Germany.
On 1 September 2006, DPPPR requested the applicant clarify his request. On
5 Sep 2006, he replied he should have a total of two AFAMs. DPPPR
requested the applicant fax in the order awarding him a second AFAM. On 7
Sep 2006, the applicant replied he was unable to provide a Special Order
awarding him the AFAM with One Oak Leaf Cluster and requested his case go
before the AFBCMR.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant for
review and comment on 22 Sep 2006. As of this date, this office has
received no response (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. The documentary evidence provided by the
applicant was sufficient to convince us that the award in question should
have been a part of his record prior to the 95A6 promotion cycle. The
applicant’s name was inadvertently left off Special Order GA-1864 awarding
the Air Force Achievement Medal to recipients for outstanding achievement
during the period in question. It appears that his rater attempted to
correct the oversight by nominating the applicant for the Air Force
Commendation Medal (AFCM) upon his tour completion which would include his
Operation DESERT SHIELD assignment. However, he was incorrectly advised
that the applicant had already received an AFAM for that service.
Subsequently, the AFCM recommendation was downgraded to an AFAM, and the
applicant never received his AFAM for his services performed during
Operation DESERT SHIELD. In view of the foregoing, we recommend the
applicant’s records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that he was awarded the Air Force
Achievement Medal, First Oak Leaf Cluster (AFCM 1OLC) on 19 August 1992,
and that he be afforded supplemental promotion consideration for cycle 95A6
with inclusion of the AFAM (1OLC).
If supplemental promotion consideration results in the selection for
promotion to the higher grade, immediately after such promotion, the
records shall be corrected to show that he was promoted to the higher grade
on the date of rank established by the supplemental promotion and that he
is entitled to all pay, allowances, and benefits of such grade as of that
date.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of
Section 1552, Title 10, United States Code (70A Stat 116), it is directed
that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that he was awarded the Air
Force Achievement Medal, First Oak Leaf Cluster (AFAM 1OLC) on 19 August
1992, and that he be afforded supplemental promotion consideration for
cycle 95A6 with inclusion of the AFAM (1OLC).
If supplemental promotion consideration results in the selection
for promotion to the higher grade, immediately after such promotion, the
records shall be corrected to show that he was promoted to the higher
grade on the date of rank established by the supplemental promotion and

A complete copy of the Air Force evaluation is attached at Exhibit C. The Chief, Inquiries/AFBCMR Section, AFPC/DPPPWB, reviewed this application and indicated that the first time the contested report was considered in the promotion process was cycle 97E9 to chief master sergeant (promotions effective Jan 98 - Dec 98).
