APPLICANT REQUESTS THAT:
Her Officer Performance Report (OPR) rendered for the period 9 February
2005 through 8 February 2006 be amended by changing the signature dates to
read 12 March 2006 rather than 24 March 2006; her Officer Selection Record
(OSR) be corrected to include the corrected report, and that she receive
Special Selection Board (SSB) consideration for promotion to the grade of
lieutenant colonel (Lt Col) for the Calendar Year 2006 (CY06A) Lt Col
Central Selection Board.

APPLICANT CONTENDS THAT:
The CY06A selection board was unable to provide her proper consideration
due to the unfair omission of the 8 February 2006 OPR from her OSR. The
additional rater of the contested OPR and her commander supports changing
the signature dates prior to the convening of the CY06A board.
In support of his request, the applicant provided a letter from the
additional rater of the contested report and a letter from commander.

STATEMENT OF FACTS:
The applicant is currently serving on extended active duty in the grade of
major with a date of rank of 1 February 2002.
The applicant has one nonselection to the grade of lieutenant colonel by
the CY06 Lt Col Selection Board which convened on 13 March 2006.

AIR FORCE EVALUATION:
AFPC/DPPPEP recommends denial. DPPPEP states the contested report closed
out on 8 February 2006. IAW AFI 36-2406, Table 3.6, rule 1a, the Military
Personnel Flight (MPF) should have received the completed OPR 30 days after
the close-out of the report (8 March 2006). The report then should have
been forwarded to AFPC 45 days after the close out date (23 March 2006) and
filed in her selection record 60 days after the close out date (7 April
2006). Since the report is not required to be a matter of record until 7
April 2006, the report is not required to meet the promotion board. In
this case, the final evaluator did not sign the report until 24 March 2006
(11 days after the board convened); it was not received by AFPC until 4
April 2006 (well after the completion of the board).
Furthermore, eligible officers meeting a board have the option to submit a
letter to the board president addressing any matter of record concerning
themselves that they believe is important to their consideration for
promotion. As such, the applicant could have written a letter to the board
members informing them of the accomplishments mentioned in her report.
DPPPEP has verified that she did not elect to exercise this entitlement.
The time to submit a letter to the board is prior to convening of the
original board, not after her nonselection for promotion.
Based on this recommendation, the Chief, Officer Promotion, Appointments,
and Selective Continuation Branch, HQ AFPC/DPPPO, finds no basis to grant
SSB consideration.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 15 September 2006, the evaluation was forwarded to the applicant for
review and comment within 30 days (Exhibit D). As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. The applicant’s contentions are duly
noted; however, after reviewing the evidence of record, we agree with the
Air Force that the contested OPR was not required to be a part of the
applicant’s record at the time she was considered for promotion to the
grade of lieutenant colonel by the CY06A Lieutenant Colonel Central
Selection Board. The statements provided by officers in her rating chain
supporting her appeal are duly noted; however, we do not find those
assertions sufficiently persuasive to override the rationale provided by
the Air Force. Therefore, we agree with the opinion and recommendation of
the Air Force office of primary responsibility and adopt its rationale as
the basis for our conclusion that the applicant has not been the victim of
an error or injustice. In the absence of evidence to the contrary, we find
no compelling basis to recommend granting the applicant’s request.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not demonstrate the
existence of an error or an injustice; the application was denied without a
personal appearance; and the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered with this
application.

Each time the report was corrected the current date was used to re-sign the report rather than the date the report was originally signed. The rater states the original report was signed prior to the selection board; he was forced to re-accomplish the report, not only once but twice, preventing the report to be viewed as part of the promotion record. In support of his request, applicant provided emails to/from his senior rater, a statement from the senior rater, an email from the HQ AFPC nonselection counselor, drafts of the OPR, and his previous appeals to the Evaluation Reports Appeal Board (ERAB). Col B-- was the senior rater of the CY01B PRF and the contested CY02B PRF, as well as the rater of the contested 16 Feb 02 OPR.
