APPLICANT REQUESTS THAT:

His records be corrected to show the “V” device was added to  his  award  of
the Distinguished Flying Cross (DFC).

APPLICANT CONTENDS THAT:

He received his 5th Oak Leaf  Cluster  to  the  Distinguished  Flying  Cross
award on 3 January 1944.  He wants to know if he meets the requirements  for
the “V” Device issued on 30 June 2004 by the Secretary  of  the  Air  Force,
Dr. James G. Roche.  In  support  of  his  request,  the  applicant  submits
copies of letters to and from the National Personnel Records Center, a  copy
of an article about the “V” Device, and copies of documents  extracted  from
his military personnel records.

STATEMENT OF FACTS:

The applicant was relieved from active duty and  retired  in  the  grade  of
major on 31 October 1963.  Applicant was credited with  23  years,  1  month
and 18 days of total active duty service, to include 5 years and 2  days  of
Foreign Service.

The applicant’s records indicate he was  awarded  the  Distinguished  Flying
Cross (5OLC), the Air Medal (2OLC), the Distinguished Unit  Citation  Device
(2OLC), the Good Conduct Medal, the  American  Defense  Service  Medal,  the
American Campaign Medal, the Asiatic-Pacific Campaign Medal, the  World  War
II Victory Medal, the Army Occupation Medal, the  National  Defense  Service
Medal, the Korean Service Medal, the Air Force Longevity  Service  Award  (4
Bronze OLC), the Republic of Korea Presidential Unit  Citation,  the  United
Nations Service Medal, and the Air Force Commendation Medal (1OLC).

AIR FORCE EVALUATION:

HQ AFPC/DPPPR recommends denial.  DPPPR states the “V”  Device  is  intended
to clearly distinguish and denote a DFC awarded for heroism.  Any Air  Force
member or veteran who was awarded  the  DFC  for  heroism  on  or  after  18
September 1947 is now authorized to wear the “V” Device on the  DFC.   DPPPR
indicates that DFCs approved for heroism between 18 September 1947 – 2  June
2004 will not be reaccomplished to reflect valor, nor will this  entitle  an
individual to be considered for supplemental promotion board  consideration,
nor will it require update of the DD Form 214  (for  retirees  or  separated
veterans).  DPPPR explains the DFC for heroism approved on or after  3  June
2004 will reflect the “V” Device on all elements.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force  evaluation  was  forwarded  to  the  applicant  for
review and comment on 24 June 2005.   As  of  this  date,  this  office  has
received no response (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or
regulations.

2.  The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice.  We note that  the  applicant  was  awarded
the Distinguished Flying  Cross  for  heroism  in  1944.   As  a  matter  of
information, the “V” device is authorized to denote  a  specific  award  for
heroic acts that are  heroic  or  valorous  by  nature.   The  Distinguished
Flying Cross is considered a valorous award; therefore, the  “V”  device  is
not required and is considered superfluous.  In view of the above,  we  find
no basis to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of probable material error or injustice; that the  application
was denied without a personal appearance;  and  that  the  application  will
only be reconsidered  upon  the  submission  of  newly  discovered  relevant
evidence not considered with this application.
