APPLICANT REQUESTS THAT:
Her name be changed to (SANITIZED) on her retired pay records.

APPLICANT CONTENDS THAT:
She was married on 31 December 2005 to Mr. (SANITIZED) and assumed his
name. She requests assistance to update her records to reflect her name
change.
In support of the application, the applicant submits a copy of a letter
from the Social Security Administration, a copy of her retired Air Force
identification card, and a copy of her marriage certificate. The
applicant's complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
The applicant was honorably discharged from the Air Force on 31 August 1998
in the grade of Master Sergeant (E-7).
In a letter dated 15 March 2006, the applicant was instructed by the Air
Force office of primary responsibility (HQ AFPC/DPSO) to provide either the
original or a certified copy of her license and certificate of marriage so
that they might update her records (Exhibit E).
The marriage certificate provided by the applicant is not an original or
certified copy; therefore, it does not meet the legal requirements to be
used as a source document.

AIR FORCE EVALUATION:
HQ AFPC/DPSO recommends denial. DPSO states Air Force Instruction 36-2608,
states that the documentation required to change or correct a name as a
result of divorce [sic] is the original or certified copy of the divorce
decree [sic]. DPSO notes a letter was sent to the applicant requesting the
required document and as of 9 May 2006, the applicant has not provided the
necessary documentation.
Examiner’s Note: Verified with the DPSO that their reference to “divorce
and divorce decree” should read “marriage and marriage certificate.”

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force Evaluation was forwarded to the applicant on 19 May
2006 for review and comment within 30 days. As of this date, this office
has received no response (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for the conclusion that
the applicant has not been the victim of an error or injustice. Therefore,
in the absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of probable material error or injustice; that the application
was denied without a personal appearance; and that the application will
only be reconsidered upon the submission of newly discovered relevant
evidence not considered with this application.
