APPLICANT REQUESTS THAT:
1. He be considered by a Special Selection Board (SSB) for promotion to
the grade of colonel by the Calendar Year 2000A Colonel Central Selection
Board
2. A Promotion Recommendation Form (PRF) be accomplished and marked with a
“Definitely Promote (DP)” and included in his record prior to the SSB.

THE APPLICANT CONTENDS THAT:
His year group’s primary 0-6 promotion board took place on 17 July 2000,
when he was still serving on active duty as a major. Due to the fact that
he does not have a PRF for colonel in his record, his request that a PRF
marked “Definitely Promote” is right, reasonable, and just. Because he was
illegally discriminated against in 1994 on the basis of race and gender, he
was precluded from the Professional Military Education, the command
positions, and the staff assignments that would have made him competitive
for promotion to 0-6.
In support of his appeal, the applicant submits a copy of his selection
notification and Senate Confirmation and a copy of the Record of
Proceedings dated June 16, 2005. Applicant’s submission, with attachments,
is at Exhibit A.

STATEMENT OF FACTS:
On 26 September 2005, the applicant was selected for promotion by the
Special Selection Board for the CY94A Lieutenant Colonel Line Central
Selection Board with a retroactive date of rank of 1 September 1995.

AIR FORCE EVALUATIONS:
AFPC/DPPPO recommends the applicant’s request for an SSB for the CY00A
Colonel board be approved. DPPPO advises that based on the applicant’s
DOR, he would have been eligible to meet the CY00A Colonel Central
Selection Board. Therefore, the applicant does have an entitlement to meet
the Colonel boards he missed. The AFPC/DPPPO evaluation is at Exhibit B.
AFPC/DPPPE strongly recommends the Board deny the applicant’s request that
a PRF be accomplished and marked “DP.” However, DPPPE recommends the Board
direct the member to his Senior Rater to have a PRF accomplished. DPPPE
advises that the purpose of the PRF is to provide performance-based
differentiation to assist central selection boards. Senior Raters are
solely responsible for evaluating each officer’s Record of Performance and
Duty Qualification History Brief and for either awarding PRF
recommendations among officers or submitting officers to compete for
aggregation or carry-over DP recommendations through the Management Level
process. Additionally, DPP recommends the Board direct the Officer
Performance Reports (between 1 September 1995 - 1 March 2003) be corrected
with the new rank of lieutenant colonel.

APPLICANT’S REVIEW OF AIR FORCE EVALUATIONS:
On 19 May 2006, a copy of the Air Force evaluations was sent to the
applicant for review and comment. As of this date, this office has not
received a response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of error or injustice to warrant providing the applicant
promotion consideration by a Special Selection Board (SSB) for the CY00A
Colonel Central Selection Board. Based on the applicant’s selection to
lieutenant colonel by an SSB with a retroactive date of rank of 1 September
1995, the applicant would have been eligible to meet the CY00A Colonel
Central Selection Board. In view of this fact, we recommend the applicant
be considered for promotion to colonel by the SSB for the CY00A Colonel
Central Selection Board. In regard to the applicant's request that he be
given a Promotion Recommendation Form (PRF) with a "Definitely Promote"
recommendation, we understand the applicant's contention regarding this
request, however, we agree with the AFPC/DPPE opinion that senior raters
are solely responsible for evaluating each officer's record of performance
and duty qualification history brief and for either awarding PRF
recommendations or submitting officers to compete for DP recommendations.
Therefore, we believe the applicant should be provided relief only to the
extent recommended below. Such action, in our view, would provide the
applicant a reasonable degree of equity and, at the same time, protects the
integrity of the officer promotion system.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that:
a. He be considered for promotion to the grade of colonel by a
Special Selection Board (SSB) for the Calendar Year 2000A Colonel Central
Selection Board.
b. The Senior Rater for the CY00A Colonel Central Selection Board be
tasked with assessing the applicant's Officer Selection Folder and
preparing an appropriate Promotion Recommendation Form, AF Form 707.
