APPLICANT REQUESTS THAT:

His records, to include the Meritorious Service Medal (MSM),  be  considered
for promotion to the grade of lieutenant  colonel  by  a  Special  Selection
Board  (SSB)  for  the  Calendar  Year  2005A  Lieutenant  Colonel   Central
Selection Board.

APPLICANT CONTENDS THAT:

The lack of an MSM was  a  significant  factor  that  may  have  caused  his
nonselection for promotion during the CY05A board.

Applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

On 30 January 2002, the applicant was awarded  the  MSM  for  the  period  2
November 1999 to 3 January 2002.

He was considered and not selected for promotion by the CY05A Lt  Col  Board
that convened on 6 July 2005.

AIR FORCE EVALUATION:

AFPC/DPPPO recommends the application be denied and states,  in  part,  that
the applicant has  not  provided  any  documentation  to  substantiate  what
corrective action  he  took  prior  to  the  board  to  ensure  his  Officer
Selection Brief (OSB) reflected his MSM.  Officers will  not  be  considered
by an SSB if, in exercising reasonable diligence, the  officer  should  have
discovered the error or omission in his/her records  and  could  have  taken
timely corrective action.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A complete copy of the evaluation was  forwarded  to  the  applicant  on  17
February 2006, for review and comment, within 30 days.  However, as of  this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of  error  or  injustice.   We  took  notice  of  the  applicant's
complete submission in judging the merits of the  case;  however,  we  agree
with the opinion and recommendation of  the  Air  Force  office  of  primary
responsibility and adopt it’s rationale as  the  basis  for  our  conclusion
that the applicant has not  been  the  victim  of  an  error  or  injustice.
Therefore,  in  the  absence  of  evidence  to  the  contrary,  we  find  no
compelling  basis  to  recommend  granting  the  relief   sought   in   this
application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
