APPLICANT REQUESTS THAT:
He be awarded the Armed Forces Expeditionary Medal (AFEM) and the Korean
Defense Service Medal (KDSM).

APPLICANT CONTENDS THAT:
He is eligible for both awards for service during the cold war.
The applicant provided no evidence in support of his appeal. The
applicant’s complete submission is at Exhibit A.

STATEMENT OF FACTS:
On 28 January 1955, the applicant enlisted in the Regular Air Force at the
age of 20 in the grade of airman basic (E-1) for a period of four years.
The applicant was progressively promoted to the grade of airman second
class (E-3) with a date of rank of 1 September 1956. He was trained as an
Air Policeman.
The applicant’s military record indicates he was assigned to Sembach Air
Base, Germany from 1 February 1956 to 7 September 1956 and, Landstuhl,
Germany, from 8 September 1956 to 29 December 1958. The applicant was
honorably discharged on 30 December 1958. He served 3 years, 11 months and
3 days of active duty.
His DD Form 214, Armed Forces of the United States Report of Transfer or
Discharge, indicates he was awarded the Good Conduct Medal.

AIR FORCE EVALUATION:
AFPC/DPPPRA recommends denial of the applicant’s request. DPPPRA states
the AFEM was awarded for operations in Lebanon from 1 July 1958 to 1
November 1958, and the Taiwan Straits from 23 August 1958 to 1 January
1959. The KDSM is awarded to US Service members that were attached or
mobilized to units operating or serving in the Republic of Korea (ROK) from
28 July 1954 to a date to be determined (DTBD). After a thorough review of
the applicant’s military record, there is no documented evidence to
indicate he participated in US operations in either Lebanon or Taiwan
Straits; or, that he was assigned or attached to a unit in the ROK;
therefore, he is ineligible for either of these awards. The DPPPRA
evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 17
February 2006 for review and response (Exhibit D). He replied that he
would like to be awarded any campaign medal or ribbon based on his overseas
service so he can be a member of the Veterans of Foreign Wars (VFW). In a
second letter he questions the exact dates of his assignment to Germany and
expresses he might be eligible for the World War II Medal. The
applicant’s rebuttals are at Exhibit E.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. The applicant claims he is eligible for
the award of the AFEM, KDSM, and Army of Occupation World War II Medal.
After reviewing the evidence of record and the applicant’s submission, we
find that other than the applicant’s assertions, we have no evidence to
indicate his entitlement to any of the requested decorations. Therefore,
we agree with the opinion and recommendation of the Air Force office of
primary responsibility and adopt their rationale as the basis for our
conclusion that the applicant has not been the victim of an error or
injustice. Therefore, in the absence of evidence to the contrary, we find
no compelling basis to recommend granting the relief sought in this
application.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only
be reconsidered upon the submission of newly discovered relevant evidence
not considered with this application.

However, there is no evidence of record and he has provided insufficient evidence to show he served in Taiwan. Even if he served in Taiwan, the DA Form 2-1 was prepared and maintained for active Army personnel during their active service.

The applicant states that he was informed by the stated veteran counselor that he was eligible for the AFEM based on his participation in the Lebanon Crisis of 1958 (Operation Bluebat). The Military Postal Service Agency verified that in July 1958 APO 379 was Beirut, Lebanon. That all of the Department of the Army records related to this case be corrected by showing the applicant is eligible for award of the Armed Forces Expeditionary Medal based upon his deployment to Lebanon in August 1958.

We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and the recommendation of the Air Force and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or an injustice. The applicant did not provide any documentation showing he was assigned or TDY to Korea. There is no documentation in the applicant’s military records to reflect he was assigned or TDY to Korea.

The AFEM was authorized for the period beginning 23 August 1958 and required that individuals serve in the area of operations for 30 consecutive days in order to be eligible for the award. The applicant did not depart Taiwan until 10 October 1958, which is more than sufficient time to qualify for that award.
