APPLICANT REQUESTS THAT:
He be allowed to terminate his spouse only coverage under the
Survivor Benefit Plan (SBP) retroactive to the date of his Civil
Service (CS) retirement (24 May 1973).

RESUME OF CASE:
On 27 Oct 05, the Board considered and denied the applicant’s
request to correct his records to allow him to terminate his spouse
only coverage under the Survivor Benefit Plan (SBP) retroactive to
the date of his Civil Service (CS) retirement (24 May 1973). The
Board further noted if the applicant’s current spouse provided a
notarized statement concurring in the permanent revocation of her
SBP coverage currently in effect, they would be willing to
reconsider the applicant’s request. For an accounting of the facts
and circumstances surrounding the application, and the rationale of
the earlier decision by the Board, see the Record of Proceedings
(ROP) at Exhibit E.
Applicant provided a notarized statement from his current spouse
relinquishing her entitlement to the SBP annuity (Exhibit F).

THE BOARD CONCLUDES THAT:
After careful consideration of the applicant’s recent submission,
specifically a notarized statement from his wife concurring in the
permanent revocation of her Survivor Benefit Plan (SBP) coverage
currently in effect, we agree with the Air Force office of primary
responsibility and conclude that applicant should receive partial
relief. Therefore, we recommend that the applicant’s records be
corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that on 1 June 1998, he
elected to disenroll from the Survivor Benefit Plan (SBP), under
the provisions of Public Law 105-85.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:
The pertinent military records of the Department of the Air
Force relating to [APPLICANT], be corrected to show that on 1 June
1998, he elected to disenroll from the Survivor Benefit Plan (SBP),
under the provisions of Public Law 105-85.
