APPLICANT REQUESTS THAT:

His deceased father’s records be corrected to show he was entitled to  award
of the Korean Service Medal, the Air Force Good Conduct Medal  and  promoted
to the grade of sergeant.

APPLICANT CONTENDS THAT:

When his father was released in August 1949 after one  year  of  service  in
the Air Force, his rank was corporal. He was called back to active  duty  in
September 1950 for the Korean War as  an  airman  first  class  in  the  Air
Force. He served two years until he was separated  in  September  1952.  His
records should reflect he received the Korean Service Medal  and  since  his
records were spotless, he should be eligible for the Air Force Good  Conduct
Medal.

In support of his application, the applicant submits a  personal  letter,  a
copy of the former member’s certificate of death and DD Form 214.

STATEMENT OF FACTS:

The former service member enlisted in the regular Air Force  on    5  August
1948 in the grade of private. He separated from the Air Force  on  2  August
1949, under  the  provisions  of  AR  615-362  (hardship)  and  received  an
honorable  discharge  in  the  grade  of  corporal   (E-3).   Corporal   was
redesignated as airman second class.

On 26 October 1949, he voluntarily enlisted  in  the  Reserve  Corps  for  3
years in the grade of corporal. The applicant returned to active duty on  27
September 1950.

On 25 September 1951, the  former  member  was  involved  in  an  automobile
accident which resulted in the amputation of his left arm below  the  elbow.
On 30 November 1951, a Line of Duty Determination concluded the  injury  was
incurred in line of duty.

On 11 August 1952, a  Physical  Evaluation  Board  (PEB)  found  the  former
member unfit for  further  military  service  and  recommended  that  he  be
permanently retired with a 70 percent disability  rating.  During  the  PEB,
the former member also acknowledged that he did not serve  while  on  active
duty in a grade higher than that currently held (airman second class).

On 31 August 1952, the former member was permanently  retired  for  physical
disability in the grade of airman  second  class.  He  served  3  years,  10
months, and 5 days total service for pay purposes in  the  grade  of  airman
second class.

The former service member’s DD Form 214 states he  was  not  authorized  nor
awarded any decorations, medals, badges, or commendations.

On 25 June 2005, AFPC/DPPPR indicated  to  the  applicant  that  the  former
member was not authorized the Korea Service Medal because he did  not  serve
in Korea or any foreign country during his military service.

On 19 July 2005, AFPC/DPPRS corrected the former member’s  DD  Form  214  to
reflect the Air Force Good Conduct Medal and the National Service Medal.

AIR FORCE EVALUATION:

AFPC/DPPPWB recommended the  request  be  time  barred.   Should  the  Board
choose to  decide  the  case,  this  office  recommends  the  former  member
promotion beyond the rank of airman second class  be  denied  as  they  find
nothing in his record to indicate  an  error  or  injustice  was  made  that
prevented his promotion  to  the  next  higher  grade.  They  also  find  no
promotion order indicating he was  ever  selected  for  promotion  prior  to
retirement

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to applicant  on  5  August
2005 for review and response.   As  of  this  date,  no  response  has  been
received by this office.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of an error or injustice.  In this respect, we note that in  order
to  be  awarded  the  Korean  Service  Medal,  service  members  must   have
participated in operations in Korea during the period of 27 Jun  50  through
27 Jul 54.  Evidence has not been presented  that  supports  the  contention
that the former member was present  in  Korea  during  the  time  period  in
question. Furthermore, we note that during  the  Physical  Evaluation  Board
(PEB), the former member was  found  unfit  for  further  military  service.
During the PEB, the former member acknowledged that he did not  serve  while
on active duty in a grade higher than  that  he  currently  held  which  was
airman  second  class.   Therefore,  in  the  absence  of  evidence  to  the
contrary, we find no compelling  basis  to  recommend  granting  the  relief
sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of probable material error or injustice; that the  application
was denied without a personal appearance;  and  that  the  application  will
only be reconsidered  upon  the  submission  of  newly  discovered  relevant
evidence not considered with this application.
